FocalPrice - Should I open a dispute?

Ordered a pair of headphones for $23 on the 8th and they still haven't been shipped. They have been stuck on 'packing' since the same day.

Checking the T&C it says that as soon as it changes to packing they cannot cancel order and I just have to wait.

Ive found the same headphones for a bit more on a UK site now and would rather just get my money refunded. I think its pretty clear they were not in stock but they changed to packing so I couldn't cancel. Is it worth opening a paypal dispute to get the money?

I have emailed focalprice but no reply as yet

Yeah sent the email to try to do so but no reply. But by looking at T&C I can imagine they are just going to say no because its changed to packing

Can I cancel my order and get refunds?
-If the order payment status is “Unpaid”, you can delete it directly.
-If the order has been paid and the shipment status is "Unshipped", you can contact us to cancel the order and get refund.
-If the order has been paid and the shipment status is “packing” or "shipped", we are unable to cancel or modify the order any more.You can choose to send back the unopened products when you receive it. We will refund after we receive them.

Yeah paypal but not sure if it would be successful due to their terms. If they haven't replied by tomorrow morn I'll prob just enter dispute hope for the best. Cheers

Ive had a paypal despute with them for something I was waiting a month for. Put it in despute and they said "dont worry .... well send as soon as we have it but only if I cancel the claim." I didnt, they didnt, Paypal refunded. Sorted.

Thanks guv. Wouldn't mind so much if they just stated it was out of stock and gave me the option to cancel but I feel they are just being dishonest. Oh well at least a British company will benefit instead!

My item was in stock when ordered. Then kept having the shipping date changed. After the 4th time and PM being ignored, I just used Paypal dispute. Not surprisingly, they wanted to speak when that happened!

Just an update got my refund in the end from FocalPrice didn't put up much of a fight ordered the same headphones, soundmagic pl-30 from pricethriller.com for a few quid more. Would highly recommend them so far btw. UK based so no long shipping and emails updating order status at every stage.
