I was the first to order this phone then posted it on HDUK

Now I and others who ordered have got a letter today saying they have cancelled my order as they are' OUT OF STOCK' !!!!!!!!!!!!!!!!!, amazingly it IS still for sale for £49.00:

SAME phone now for sale at £49.99, BUT apparantly NOT available to us ???.

I emailed them and stated it was a fraudulant representation and would report them to trading standards and BBC watchdog. WHY DON'T WE ALL ???, see if they can explain there way out of this.

Disgraceful (underhand) business practices.

you might want to get your "1" key checked out. it seems to be sticking when used in conjunction with the shift key!

I received a letter the other day notifying me they will dispatch the phone when it comes back in stock. The very nest day i receive another letter saying: 'we very much regret that the stock we were expecting has still not arrived. Despite efforts it now seems unlikely that we will be able to obtain further supplies of the item. We have therefore decided to cancel your order and confirm that your credit card has not been debited'

What a joke, and quite obviously fraudulent behaviour since their website says they have some in stockand are selling them for £49.00! OUTRAGEOUS!!!!

They should be reported to trading standards!

I have had the same 2 letters as many others and regard this attitude by Freemans as worse than fraud. It is about time that a boycott of Freemans and other similar companies was organised.

I did, use it as a template Email for all others who got cancelled if you want it:

Dear Customer Services,

I am again contacting you following our correspondance, below, with regard to my order for the Motorola W377 phone.

I have today recieved a letter explaining you have now cancelled this order, despite your confirmation emails and the assurance given below, I fail to see how you find yourselves able to conduct business on this basis !!!.

I therefore request that you supply me with a Motorola W377 of any colour which IS available from your website, i.e:

IF this order is not honoured or fulfilled I will report this matter to trading standards and BBC Watchdog as a fraudulant mis-representation in accordance with the sale of goods act. I have screen shots of the order, the email correspondances and letters to verify my case.

I await your reply and my Motorola W377.

I have just spoken to one of their supervisors who says they are quite within their rights to cancel orders if an administrative error has been made (in this case the price). However, I told her that the letters have no mention of this and completely conradict what she's saying. I guess i'll have to get on to trading standards

Does anyone have a free phone number for them, we should all complain on the phone also.

Dont have their phone number, but I phoned using a number from saynoto0870. Got the same old waffle, about how it was a misprice etc etc. They then told me as it was an online order, that I would have to send an email to customer services and go from there. Am not holding out any hope though!

I AM very pleased for those who did get these, at least some cheap deals were had :thumbsup:

As a first time customer of there's I find the business practices disgraceful and think we 'all' at HDUK should boycott all ALLEGED deals they offer, as inevitably they WONT honour it

The girl on the phone said they couldn't get any more stock at £18, that is wasn't a miss price, and would I like her to reserve me one. Told her if it was £18, yes please, if it was £49, don't bother! she said it was unlikely they would have any more. and even talking to supervisor wouldn't help, and to ring back in 3 days ( will do this today) and speak to the marketing department. . Well blow me down with a feather, guess what turned up this morning ??? a phone yesssss....... errrr with an invoice for £49 :x I am wondering, the people who did get the phone, are you new customers? I am already a Freemans customer, although I hardly ever buy anything from them! Well I will be ringing them again today, and telling them I will keep the phone, but only if its £18. Will report back later.

I hate how companies do this and refer to their T+C's as a get out clause. Even though its all done by the book it does proove a relatively poor customer experience.

To be fair, companies do often have a certain amount of stock at a reduced price, but once they have sold that stock, they are within their rights to charge the previous price. If you go into a supermarket and something is on BOGOF because they have been given promotional stock by a supplier, you can't go back in 2 weeks later when the offer is finished and demand to be sold the product on BOGOF again just because that's the deal they once offered.

Some people seem to have received their phones, so it's not like they automatically cancelled every order. Don't forget that thousands of people read this site every day, so a lot of people might have ordered one. They may not process their orders in the order they were received (which isn't ideal, but might happen). I understand you are angry at not getting the deal, but a lot of times it's the luck of the draw.

Well to quote myself! Have just got off the phone to Freemans, and despite all my reasoning I cant have it at £18. I did my very best too! Supervisor said the same, then after talking to the Internet team, she rings me back to say yes it was a miss price despite the others telling me it wasn't, and it was cancelled. Hmmm, told her that some people did get it at that price though. So annoying to have it here in my hands, but only if I want to pay £49 for it :x

Well, they didn't. But someone up there said " The girl on the phone said they couldn't get any more stock at £18, that is wasn't a miss price" so I guess that was the case.

i ordered those mikey necklaces for 2 quid... rang them up as wasnt showing on account... apparently out of stock and no gurantee id get them wen they were being ordered fro (april)... so i cancelled order. yup these catalouges r annoying!

I understand the safeguards for blatent mis price protection for traders BUT when they acknowledge your order, promise delivery and then two weeks just change their mind claiming out of stock whilst selling the same item at a much higher price that is just taking the michael.

Have sent a very strong email to customer services as per suggested template and we'll see what happens (probably nothing). Really do feel that this sort of trading practice should be stamped on by trading standards.

But the point is they had a certain amount of stock of the phones priced at £18, based on stock they had been sold at a reduced price. Now they only have stock priced at £49, based on stock they have been sold at a higher price. They don't have stock of phones priced at £18. They have sold out.

I know I sound like I work for Freemans or something, but I just think people's annoyance at not getting a cheap phone is blinding them to the logic of the situation.

As the scum freemans have refused us this on the basis of "out of stock " clearly it's not.

Sorry I don't agree with you. Yes I'm miffed at not getting a deal but not one that I actually went for thinking it was an obvious misprice. If it was a genuine out of stock situation that I'd have to live with it BUT they are still selling these!! albeit at nearly £50. How the hell does anyone know whether it was cheap stock or not and frankly thats their problem when they go as far as they did in accepting an order.

I have been exchanging pointless emails with their joke of a customer service department and I for one have no intention of dealing with them ever again and will be actively advising anyone else to tell Freemans where to get off in future. From what I read on this and other forums Freemans have a habit of pulling this type of stunt and if you want to give them the benefit of the doubt go ahead but count me out!!

*sigh* Someone above said they were told they were out of "£18 phones". Suppliers often sell stock to a retailer at a reduced price, meaning the retailer passes that saving onto the customer. If "Motorola" sold them 500 phones at £10 each, they sold them for £18, and made a profit. Then "Motorola" says the next 500 phones cost £35 each, so they sell them for £49 to make a profit. It's like I said about BOGOF supermarket deals - most offers don't last forever because suppliers don't constantly offer cheap stock. It's the same thing.

I appreciate what you are saying but I think the main problems we have with this in order are:

1. Email confirmation

2..Letters saying they WILL send it when they have more stock.

3. another Email confirmation

4. Second letter cancelling the order as they are now completely 'out of stock' but still online for £49

5. phone call in which they say the will not honour it as it was a 'mis-price' online

They are wholly untrustworthy, dis-reputable liars. We cannot believe a thing they say.

I suspect this was a carrot to lure us to order and sign up :x I think you will see a LOT of boycotting ALL deals with s**tlewoods, freemans and additions from now on, and rightly so

This wasn't a 99p sat nav mis-price it was supposed to be a genuine offer, also these are 30 quid in tescos now
