Last night I saw this mobile phone on Focal Price for $8.16. It looked like a brilliant deal with quad band, dual sim, bluetooth, mp3/mp4, 1mp camera, large touch screen, fm radio, expandable microsd memory and two batteries. It was a noname brand and the box was all in chinese, but I thought at £5.17, why not? It didn't say 'In stock' but I ordered anyway, hoping to be next on the waiting list for when it came back into stock. So the payment has all been sent through Paypal. This morning, I find the price had increased by over 1000% to $87.58!!!!! Mega misprice!

What can I expect from Focal Price? Will they try and cancel the order and refund me and do I have any rights as a consumer to demand they send me the phone? They will probably be losing a good $30 to $50 if they proceed as usual. I was going to post it on HUKD, but I since focalprice charge in $$$, I wasn't sure...

Please any help will be well appreciated and repped o'course!

You cannot demand that they send you the phone. Its an invitation to treat and not an offer to sell. There are many other reasons that we can go in to but it would be irrelevant.

Just cross your fingers and hope!!!

Are you talking about:

It is a frequent mistake from Focal Price. Do not try to buy it, because they will not sell it for this price and it will take some time to be refunded.

I saw that this morning actually, but it doesn't seem possible as I thought there would be some consumer rights involved.

Luckily it has English, French, Spanish, Portuguese, Russian and Thai languages. However, it may not be English in default so I'll have to learn a bit of the lingo in order to turn it to English.:p

hmm... I do agree with you, but I don't see how FP could justify it. I mean, you can't go into a shop, bring something to the checkout, give them the money and then be told that the item had just risen in price and that I have no choice but to hand over the remaining money. If they do give me a refund, it better not have any paypal fees related to it!

I suspect you may struggle enforcing UK consumer law on a company based in Hong Kong

No, I just posted the link for everyones ease.

There are consumer rights involved. For instance, they can give you the choice of paying the full whack or you can cancel your order. You will need to wade through their Terms & Conditions. If they had a good lawyer when setting up their website then they will have covered themselves to the point of taking your money and shipping the item!

Good idea. Hopefully it'll be in English though, as I think FP is aimed more for English speakers than people in China. It also doesn't give much details about the charger. I assume it'll be US.

Good point. I've just spotted this in their 'terms of use' section:

Please note that there may be certain orders that we are unable to accept and must cancel.focalprice.com reserves the right, at sole discretion, to cancel any order for any reason. Some situations that may result in your order being canceled include limitations on quantities available for purchase, inaccuracies or errors in product or pricing information, or problems identified by our credit and fraud avoidance department. We may also require additional verifications or information before accepting any order. We will contact you if all or any portion of your order is canceled or if additional information is required to accept your order.

Dear customer,

Thank you very much for your order in focalprice.

But we are so sorry that we made a mistake for the MH593B unit price. We mark 8.16USD on our web, but its correct unit price is 87.58USD. Do you agree pay the left 79.42USD or get 8.16USD for one MH593B?
If you agree, please pay to [email protected]">[email protected] , would you please give us a message when you finish your payment.
If you don’t agree, please send us a message for refund, we will refund you in two working days.
If we get nothing information from you, we won’t give you any solution.

Thank you!
Look forward to your fast reply.

Give up, there is not a huge amount you can do, you wont be able to contest it as they are not based here.
