GAME still selling used games as new! and admit it in an email reply (posted below) Anyone else got a used game instead of new?

I know this has been discussed before and GAME apologised and stated it was a mix up due to the busy easter period, that the games were not used but ex display. Well a year later they are still at it!

I bought Dead 2 Rising Zombrex edition the other day and received a used copy with a dented box, smudges on the disc's and the syringe pen was not in the box. I phoned a local game store and was told my options were to return for a refund, exchange for a different game as they had not stocked this for ages or send it back and run the risk of getting another used one!!!

Then I had a reply from customer service, see below....

GAME did it again in 2013 and still claimed that it was just because the game was ex-display. However, not only the wrap was ripped off but the leaflet was damaged badly, which definitely was not because of being ex-display

I've vowed never to use GAME again after this last month. I've used them three times over Christmas-my first item was crushed to bits, my second was sent used & damaged instead of new, and my third was a download code for an "online only" game that had it's servers turned off eight months ago. Each time I've had to return the items to store, since there has been no replies to my emails, I cannot get through on the telephone, and the webchat is constantly down "due to unexpected demand".
The attitude of the staff in my local store has been appalling. They tried to flatly deny that the items I received would have been sent out in the manner I received them, and have tried to wriggle out of refunding my money by telling me that they can only offer GAME vouchers to refund online sales in-store-despite what is written on the delivery note and on the website. I was told that it is standard to wait 28 days for replies to emails, and I was actually told by one of them that- and I quote: "you should never use the online service anyway, as they are absolutely rubbish."
To top this off, I have seen staff actively lying to unaware customers about products. I thought that it was maybe a mistake by the salesperson at first, but after the customer walked away the guy was talking to his manager and taking the p*ss out of the customer- boasting about how "these idiots will believe anything"
I find it inconceivable to believe a company that was so close to liquidation two years ago have let their standards slip away so quickly, but hey, when I said this to the manager the other day, I was told "what's that got to do with anything?"

Just confirmed. The 'brand new' game they sent to me in 2013 was preowned when I received it, which means they never stopped that dirty work. If you get another unsealed 'new' game from GAME, just return the product without hesitate and don't trust the **** of their customer service which will try to convince you that the game is 'new'.
Of course, they also told me that due to lack of proof the game couldn't be returned and blamed me for trusting the customer service a year ago, for not returning the game when I got it and for taking others' words to communicate with them about that case now.oO

An item can be new (not have a previous owner) without being sealed.

Perhaps that is your problem when communicating with GAME(digital)'s representatives.

If you want a sealed item, ask for that. Do not assume all new items are sealed; because they are not.

If you want a sealed item, ask for that. Do not assume all new items are sealed; because they are not.
the item was not only unsealed ( I know sometimes the new games could be taken out of the box before being sold and if so I would not mind), but the menu in the box was damaged, of which the picture is used as my profile phone at the moment. I also showed this picture to another GAME CS member today and he told me that the game was preowned, but unfortunately in the past year they kept denying or ignoring it.
It had been reported that GAME( or some of its evil employees) sometimes sold preowned games as new since 2010, and such thing happened again in 2013. I also hope I would be the last victim of GAME's such selling strategy, but I think the accident happened last year still means such accident is still highly possible. I personally also used to trust GAME and regarded it as the most trustworthy online game seller in UK, and this is also why when GAME promised me the game was 'new' a year ago I chose to accept it without returning it back to have refund or replacement

"I am sorry to hear your order has arrived in an unacceptable condition. These games are new, however due to demand we have moved some stock back from stores. This stock should be in MINT condition however it may be ex-display. This stock is new (it has never been owned by anyone other than us, and certainly it has never been played) however it may have been stripped of its plastic sleeve.

If you have bought a new game from us, then we will have sent a new game to you. If you receive a game that is damaged or you are not happy about its condition, then please let us know and we will replace it or refund it, subject to our normal terms and conditions."
Above is the email I got last year. GAME agreed to refund or replace at that time but still insisted the game was new.

Below is another reply via GAME webchat after I sent the GAME CS member the picture of the leaflet/menu.
“ if it seems it has been pre owned and not new then you can take it back to store for an exchange if you say to them what you have said to me.... if this was pointed out much sooner it would have been fine to do within 28 days but after a year i am afraid there would not be enough proof of this i am sorry...i am afraid it would have been down to you to check it after you bought it rather then wait a year on someone elses word...if they had said it was new and you opened the box within 28days and seen this damaged leaflet then we could have possibly exchanged it for you”

I didn't choose to return it one year ago because if the game was not preowned but just ex-display it would be still acceptable and would not worth to bother to return and to wait for a replacement. Of course, there is also my fault in it which is to trust GAME by mistake, and If they admitted the game was pre-owned at that time I wouldn definitely return it without hesitation.

There are many "ifs" within that text.

You may be correct. It may have been a pre-owned item, or one taken from a store display then sent back to the mail order team in order to despatch to you, but I cannot see why you should expect GAME to do anything about it so long after the purchase date.

Lesson learned I hope.

I once bought a GAME from Trafford Centre Game it was preowned, got home and it was more scratched than a cat post, so I lived in Bolton at this time, returned it to Bolton and they said!

"Yeah Trafford Centre game are always doing it" they then refused to swap or refund it, it took a 45+ minute argument and a mobile call to an area maanger to sort it.

Since that day i have never bought anything instore at GAME, absolute Joke of a company, it lost its way after the PS2 launch.

I still got something from GAME -- a 'FREE' lesson about never accepting unsealed items from GAME and returning them as soon as they are delivered.

Examining goods as soon as practically possible, & especially mail order goods within seven working days (prior to 13 June 2014), or now within fourteen days (from 13 June 2014 onwards) is always advisable.

They are still at it. When these cheap blu-ray and game deals pop up and then dissapear within 5 minutes I have caught a few of them. I even posted a couple of deals myself around the same time. When they all arrived they were ALL opened with a game sticker seal on top. One looked like a dog got it and another was filthy and sticky, the other was in 'good condition' all cases had scratches and obvious shelf wear.

I called game, they apologised on the phone and admitted fault when checking my order online and verified that I bought 'new' items but they wouldn't arrange collection. They said "the easiest" thing to do is to take the games into store to return them and when asked were adamant in saying they would not give me anything for my troubles as that is just not their practice. I asked if it was ok to send out used and eaten up products as new and if they cared about losing a customer. He apologised again and confirmed that their practice no matter what will not go above and beyond for the customer despite knowingly and consistantly sending used and manky items as new. The guy on the phone also said I was the only person who has complained about this and they were not aware of the issue.

I took them into store for a refund and the guy at the counter was rudely telling me they were in fact new, other customers in the queue couldn't believe it when i turned around and looked at one in shock. He spoke up to mention it looked like a dog got it and funnily enough he also complained (on the phone) about the same thing but with a different item. The guy serving just kept saying "it's cool i will refund them 'anyway" ANYWAY? You sent out three USED and gross sticky items as NEW and made me return in store, lied to me on the phone and now calling me stupid or are the lack of seal and bite marks an effect? He then asks for my game card. "Ofcourse here is my game card so you can make sure you take the small amount of worthless points back I earned, I won't need them now anyway."

I have promised myself to never purchase from game again and I have seen similar situations with other people buying from them so I am not alone in this matter. Three strikes you're out and they got me 4 in a row. As a collector who happens to have a big family with lots of kids. Game will have lost thousands over the course of me not shopping there anymore and there won't be any more game deals from me.

I would have accepted an apology and a £5 voucher, i'm cheap :)
