I managed to get myself a parking ticket last week.
Annoying thing is I did actually buy a pay and display ticket but stupidly placed the ticket wrong way up on the dashboard, so the attendant couldn't see the expiry time etc on it.
I appealed (still got my bought ticket) and it's been refused on the grounds that although I 'paid' I hadn't 'displayed'
How mean is that?

Thats just down to some jumped up office worker who's not getting any.

I had the exact same thing and it was overturned, just send them a letter back saying you actually spoke to the parking attendent and he said that it would be overturned as he took a picture showing that I had the ticket there it had pressumably overturned when closing the door and you have the ticket as proof.

I can understand the reason as to why i got a ticket, as the attendant couldn't see any valid ticket showing, however you would think on appeal they would say something like 'don't do it again, it was a mistake and we'll let you off'
but no, not our tight bloody local council
obviously need the cash to pay their jumped up council wages

I would imagine you've got grounds for another method of appeal against this. Seems stupid, the guy couldn't move his head FFS?

Was it warm day? Maybe the heat made the glue unstick and it fell off upside down? Hardly your fault if their adhesive is not up to the job?

if they took a close up photo how could they possibly prove the upturned ticket was in your car and on your dash? It could have been any car and I wouldn't accept their word for it. You should have asked for disclosure of all of their evidence, including photos and appealed on the grounds that the onus is on them to prove it was your car.

Can't see how they can do this as it's probably impossible to take a close up picture of a ticket on the dash and get your registration number or some other kind of ID in the same picture.

Take it to the appeal process - state that you placed the ticket in the window correctly - that there was nothing to 'stick it to the window' and that when you shut your door the wind must have blown your ticket over and that you didn't notice this - because you have your ticket and a 'reason' the appeal process should let it be quashed

Depending on the wording you could argue that technically you had displayed the ticket (they have helpfully taken a photo to help prove your case). The fact that the side that they wanted to see wasn't visible is another matter.....

here is what I sent that got me off the charge:

"Good Morning

I am writing at the recommendation of the parking attendant who issued a PCN to my vehicle on xxx; (ref Rxxxx).

It seems that the ticket that I displayed on my dashboard on this date flipped as I closed my car door, thus not allowing the attendant to see the time of expiry for which I fully understand his reasons for issuing the penalty. Luckily he was still in the area when I returned to the vehicle so approached him to show the ticket was still within the allotted time and if there was anything I could do. He then explained that he had seen the reverse side of my ticket and took a picture which clearly shows the ticket number and that if I write to yourselves with an attached image of the front of the ticket, that this penalty will be overturned.

Please find this image attached, you will notice that the ticket number will correspond to that on the reverse of the ticket shown in his images and that the PCN was issued within the time in which parking was paid and as this is the first time any kind of silly mistake has been made, I'm hoping this penalty will be overturned.

On a personal note, as this was the first time I've ever dealt with a parking attendant, I found him to be very helpful and a real professional, this young man has changed my unjust perception of this profession.

If it was close to the tax disc then your reg number could well be visible, it only need the ticket to be shown upside down so not too hard to get both in one shot.

Just appeal it, you'll win as they won't spend money going all the way (and they will lose in the end as you bought a ticker regardless of how it was shown IMO)

We've had fines paid for by the council when appealing for a ticket charge and we never had a ticket in the first place (went to court, appealed twice, we won).

Does the pay and display sign mention that the ticket has to be displayed so its visible to read - or just be seen?

The ones near me just state they need to be displayed in a prominent position. Sounds like you did that!

PS...Minstrelman... that sucking up about parking attendants has really changed my perception of you! That was really pukey stuff!

Contact your local paper - they usually love stories about officious jobs-worth types at the local council.

Write to your MP. They'll jump over backwards to sort it out. I had something similar, wrote to my MP, they wrote to the cheif constable and it was sorted in a couple of weeks. Worthwhile.

Ive got a ticket before because my window frooze over and they couldnt see the ticket, after complaining they let me off but asked me next time to make sure the window didnt freeze over. I mean i can control somethings but I cant control the weather!

http://forums.pepipoo.com is the best place to go for parking advice, they've a lot of expertise there and have a high success rate of getting tickets cancelled.

Does it say on the parking ticket it has to be the correct way up? Seriously, I'd kick up such a fuss here. Use every appeal process possible (see pepipoo above) and if they do turn it down, use the press, refuse to pay, let them take you to court.

I got one a whilst back, on the day it was the only space available as the car park was have rebuilding work sand was short on spaces and i had to squeeze in and was about 3inches over the line...alll the cars in the row were, they would not back down i even wrote to the head of the council the said no, i also demanded my parking fee back, they still said no...not impressed
