Grrr...Got a parking ticket today in Manchester City Centre...

I paid in the machine for 4 hours in the machine but someone had left their credit card receipt in the tray (Which I thought was my ticket), I didn't check it and put it on my dash (cause I was late for a meal with my friends). Got back with a £50 fine under the wiper.

So is there any point trying to explain or just pay the fine? (I don't have my paid ticket as obviously someone had taken it...)

could the not check cctv if there was any to see you paying, prob a long shot but could always try. did you not have to put ur reg number in when getting the ticket, maybe they could check from this.

No receipt, then youll have to pay the fine, if you have the ticekt you would be ok

I'd appeal, you can probably do it by email - get them to check the machine etc explain what happened.

Yes, if it is a council ticket, then you will have to appeal it, more information later, with someone else, you could have just ignored it and it would have gone away.

Now, to deal with this ticket, every PCN has to have the right information on both the front and the back of it, if it doesn't, then it is unenforceable. There are some experts who can help you on http://forums.pepipoo.com/index.php if you post a thread, with either pictures or scans of your ticket, they will check for any mistakes, which is a lot more common than you may think.

Well, i'm afraid your just going to have to stump up, thats nothing you can do, you have to display the ticket, you will be done even if the ticket was on display and a gust of wind moves it onto the floor, even if they check the cameras and it proves you've paid, even if you have a receipt to prove you've paid. Its called pay and DISPLAY. Trust me on this one, i've been caught out like this, your boned, sorry.

That's not true at all - there are numerous routes for appeal as peodude has outlined and I very much agree with their recommendation for Pepipoo. The councils are relying on people just to fold and pay up straight away as they rarely follow all the rules correctly.

Just filled out an online form to appeal the charge. Fingers crossed. If it gets appealed then great but if they refuse then all I've lost is 5 mins typing out form I guess, worth having a try.

I can almost guarantee that your appeal will be rejected, unless you get someone on e very good day, as most informal appeals are rejected, in order to scare people into paying.

Does the ticket say anywhere that you have to pay, or appeal "within x days"? Many many people have won an appeal based on mistakes on the ticket, and they don't come from the data entry bit, reg etc but the standard 'blurb' on the rest of it.

the ticket says...

A penalty charge of £50 is now payable and must be paid not later than the last day of the period of 28 dyas begginingeg with the date on which this PCN was served,

i.e. not later than 19/06/2010

The Penalty charge will be reduced by a discount of 50% to £25.00 if it is paid not later than the last day of the period of 14 days beggining with the date on which this PSN was served,

i.e. not later than 05/06/2010

Just pay the £25, you screwed up, maybe next time you will look at what is on the piece of paper you pick out of the machine.

I'd be inclined to pay the £25 as you don't actually have a ticket in hand to prove you had one, only someone else's credit card receipt so the likelihood of getting out of it appears pretty slim, unless you can go down the cctv route but I'd probably just pay the £25 fine instead of risking your appeal being rejected and a £50 fine.

I've done it myself, the dates DON'T match they add up to the 4th and 18th. They have cocked it up. They have given you an extra day on both. They are NOT allowed to do this by law. This is potentially prejudicial, as you could pay on the 5th, which is the 15th day, when they are no longer obliged to take the discount, or the 19th, which is the 29th day, and your payment would be declined.

This is a mistake that should result in you winning the case, however, the council probably won't accept it, and you will have to go all the way to the independent adjudicator with it

Yeah, I agree I should have checked but its not like I didn't pay. No one likes to pay unnecessarily. If an appeal fails, I'll consider it a lesson learned...

it is always worth appealing but the bottom line is you got a ticket for not displaying a valid parking voucher therefore you are in the wrong and you have to pay.

I'm just annoyed that the last person who used the machine didnt take his receipt. Just fingers crossed I don't have to pay for such a silly mistake...

Called up Manchester council parking services today and they said if I can put it in writing and photocopy the credit card receipt they'd be able to reference it to the picture the warden took and will be able to verify that it was someone else's cc details. Pleased about the progress but no guarantee of course.

Hi, if these 5 tickets shouldn't have been handed out, and you were in the right then good for you, If , however they were fair and you've tried to get out of paying by some loophole in the law, then not so good,

£25 is not as bad of a sting. Try living in London - the reduced rate is £50-£60 for the first 2 weeks then double!!!

What bad luck for ou though - it's understandable when you're in the wrong - annoying when you're not!

3 of them were deliberately paked there, knowing i could win a ticket, 2 were accidental, but on checking the law, won them as well.

It's not a loophole that i have used, it is the law. Don't forget, the councils ticket EVERYTHING, 1 minute over, ticket, just touching the double yellow, ticket, etc. etc. Now, if we have to stick to the law 100%, then the council also have to stick to the law 100% as well. It's not hard, they are given all the guidelines on how to do it.

If their paperwork is wrong, or the signs or bays are marked wrong, then the ticket is not legally enforceable.

If they allowed leniency, then we might allow them some leniency, but they don't, so we don't

Thanks for all the replies! I have since recieved an (automated) reply stating that it will be dealt with within 10 days (And it said on the website any appeals will auromatically suspend the discount deadline until it has been resolved or rejected). Cheers!

Just an update. After a Month of waiting, I get a letter today saying that they have cancelled my ticket but if I get another ticket under the same circumstances they won't be able to do it again! Result!
