I order GT5 Prologue from Play around 2 months ago for £17.99 as they seemed to be the cheapest. Then today i check my email and i have one from them...

Dear Customer,

Your copy of Gran Turismo 5: Prologue was received late to our warehouse from Sony and has now been despatched.

As we have missed the release date Sony and Play.com would like to offer you £5 off the price of LittleBigPlanet coming soon to PlayStation 3.

Now why would i want to do that, ill have to wait until september before i get the damn thing and by then i'll probably be able to get the game for £30 somewhere else and accully get it on time!!!

It is probably sony giving play the dicount as it was sony's delay not play's as a gesture of good will and they can't get it right for everyone

I just presumed it was plays incompetence ;) not had much luck with them in the past few months. Just phone there 'custome service' and they said that it will arive some time next week :S and i cant cancel as its already being processed

wrong! typical play! sounds like they are preventing you from exercising your statutory rights under the distance and selling regulations act 2000. it states that upto 7 days after receiving an item you can return it no questions asked. but better in your case, if you cancel before you receive the item you are entitled to an immediate full refund even if they have already shipped the game. its upto them to arrange collection of item once it arrives, or send you prepaid envelope for return. either way, feel free to demand a refund :)

from OFT website guide for businesses:
The regulations give consumers an unconditional right to cancel an order. This is to allow the consumer the opportunity to examine the goods or consider the nature of a service.

If a consumer cancels an order, written notice must be given to you by:

goods – seven working days from the day after that on which the goods are received by the consumer;
services – seven working days from the day after that on which the consumer agrees to go ahead with the contract.

Where a contract is cancelled, the consumer must ensure that reasonable care is taken of any goods received and 'restore' them to you. This does not mean that they have to return them - unless you stipulate this in the contract - only that they make them available for you to collect.

I know it doesn't help massively, but can you not buy the game elsewhere, and just return the other to play for a refund when it finally arrives?

Yeah you could do this as its £17.99 basically everywhere (Apart from the PSN :w00t: )
