Gumtree, Paypal, Iphone 3G Scam

Hi, basically just over 2 weeks ago i saw a iphone 3g for £150 on gumtree, i called the guy up and said i could pay by paypal, i thought it was really cheap and too good to be true, however i thought i would be protected by Paypal. So i waited a few days for the item to arrive, it didn't, so i opened up a dispute claim on paypal, they said for me to wait 14 days before they can do anything. Today was the 15th day and they have given me only £0.70 back and the case has been closed, what should i do to get the rest of my money back?

they removed the funds from their account and there was only 70p in there when paypal ordered the refund you wont see it i'm afraid

I think the sellers need more power against the scammers and the buyers need protection that is crystal clear, this area is to wishy washy in regards to decent protection. I for one dont use ebay anymore after i was caught out by the infamous nigerian scammers :(

It says that they are working with the seller to recover the rest of your refund, so just wait and see for a few days.

how do i do this through paypal? Also will i actually have to go out to court? I have a valid name and address and confirmed paypal account, but this guy's name is t r. So i don't think he has a valid name.

i doubt they will be able to get money out if his account, but will paypal compensate, i sent the money by using the option 'goods' and not 'gift' which is what he told me to use.

Obviously he has just opened a paypal account and an email address.
Paypal will send him some debt letters but as if he has put the correct address in.
The only way of being able to track him is if he withdraw the money into his own bank account but he probably just got a paypal top up card for £5 and loaded it on to that. Or as they have got £0.70 from him im guessing he just bought some stuff he wanted off ebay or somewhere.
The silly thing is that paypal accepted the name T R, surely you have to have more than 1 letter per name. lol. its a joke.
Well as you didnt pay by your credit card, not much you can do. Try contacting your bank, they may be able to help.
But i think you have probably lost your £150.
You know what they say, if you think its too good to be true, it probably is.

Paypal are awful. I lost out on a £220 item because the other person said they didn't recieve it (even though I had post office proof of delivery). They're a joke.

it was taken from my bank account, im gonna call them up and see what they can do, as they are supposed to have buyer protection.

they said they can't do anything cause i didn't buy it off eBay and they won't give me their information either e.g. their address. but when he gets money into his account they will give it to me, thats never gonna happen. How do i open up one of those mini court things.

because apparently I didn't adhere to their terms and conditions. I exp that I wasn't the one that signed for it and supposedly the person that I sold it to didn't sign - however they said they have a signature for that address.

i have another one of his paypal address's that he told me to send it to first, but cause it had reached it's limit he told me to send it to another email address instead, so i told paypal to check the other email address for money and give that to me, they said they can't do that. I said for them to check if it is the same name or address as the paypal address i sent money to they said they cant. They can't do sh**, for every single thing they said 'no sorry we are not able to do that' i called up again and talked to another agent exact same dumb responses. Paypal is so misleading they make it out that it is the safest way to pay online as it has buyer protection but this guy gets away with it, oh yea what they will do is "limit" his account if he does not respond to paypal's emails... ooh no what a harsh punishment he can't use that account anymore and will have to open a new one.

but didnt you think to your self, hold on a second £150 for a £350 phone, thats got to be one of only a very few options 1) stolen 2) dodgy insurance 3) a crackhead, it may sound nasty and i dont want you to think i am being nasty but did you seriously see a deal like this going well ?? the fact he wanted a gift payment etc should of set bells ringing as thats a payment method i would use with only trusted people,

Type small claims court into google and see what it brings up.

I do believe you can get paypal to divulge his address by mentioning paypal in your claim.
They obviously deal with this type of thing alot.

You cant take someone to court without a (real) name and address. Youd have a hell of a job on your hands getting anything down that route-you could be throwing good money after bad. As said previousy, and without trying to sound harsh, you really should have been more careful-nobody, whoever they are, are going to sell something that cheap when they can get plenty more anywhere else all day long. Hopefully lesson learnt.

Sorry you've lost out. Gumtree is like a den of Vipers, if you cant pick it up and pay cash, dont buy from there.

PayPal, Gumtree, eBay are all rubbish. When it comes to protecting or getting your back no one can help. Never accept paypal on Gumtree or Preloved.

Really sorry for you man. Look at it this way, if that money is meant for you you will get it back one way or the other.
Anything taken wrongly can never benefit anyone so the pleasure of that money will be short lived for the op.
Report him to Gumtree though.....
And next time be more wary.
Really sorry for you. With Gumtree its always safer to do face to face as there are no guarantees
