My hacked Iphone seems to have developed a fault right at the bottom of the screen where it is unresponsive.

I was told by someone that as the phone is 7 weeks old and hacked, the only way of getting warranty is to sign up for a contract and then use the warranty and then cancel within 14 days.

I have a couple me questions:

1) Seeing as I've had the iPhone for 7 weeks is it possible for me to sign up for a contract and get warranty for it (as it does seem very suspicious that I hacked it and my warranty is void)

2) Is it easy for me to cancel the contract within 14 days of activation, if I have already claimed warranty over it?

If the answer to the previous 2 answers are yes, then...

3) Is it worth waiting for Apple to release the new Iphone in order to get the new model as a replacement for my faulty Iphone, or are they likely to give me a 1st generation replacement?

I'm not seeing how this would work. Why would a company give you a warranty for a phone when, presumably, the phone wasn't bought from them, and the contract they grant you is only for the provision of calltime and line rental? This is not a rhetorical question, by the way - check the T&Cs.

Under the Distance Selling Act, you wouldn't be entitled to. With contracts, you do get a cooling-off period, but only in the sense that you can decline to use the service and may cancel only if you have not begun using the service. If you begin using the service, it's seen as acceptance of the contract, and you're in it from there until it expires at the end of 18 months or however long it will be. Again, I'd recommend you look at the company's T&Cs, but it looks to me like your scam's going to go nowhere along this path, sorry. Can you not return it to the retailer? If it is a hardware fault, then they can't reasonably blame a software hack for causing it. Again, T&Cs, and possibly citizen's advice, are worth consulting.

Restore it then return it to apple?

Restore and re jailbreak it. I have done it to mine a couple of times including tonite when I just has an apple sign.

Well I bought it from an O2 store and I've spoken to Apple and they said that the only way of getting warranty is to sign up for the contract.

So, if anyone has had a problem with a jailbroken phone and knows definite for the questions could you please respond

Just restore it - stick it into iTunes hit restore. If this doesn't work your best option is just to make a warranty claim via Apples website

They will collect the faulty iPhone and then repair or replace it. I highly doubt they will check if its jail broken as they probably flash the iPhone before it even reaches the engineer!

Its stupid to atually speak to Apple about it!!

Just restore it - stick it into iTunes hit restore. If this doesn't work your best option is just to make a warranty claim via Apples website

Go via there website and make the warrenty claim.
