HELP: Ive just been hit by a car,

Hi

I was basically hit by a car this morning, and the guy who hit me wants to do it not through insuarance. I really dont know what to do?

What are the pro's and con's?

Has anyone had the same problem?

Also my car was written off as a category D about a year ago. Does that make a difference? Someone said the insurance company wont pay out because they have already done it once before.

Any help will be great.

shouldn't u be ringing ur insurance company and asking them these questions?
You have to inform them of the accident even if u dont claim with them!!!

Sorry to hear you've been hit :-(.
My car was written off as a cat c, i bought it back it then got hit again and is still a cat c.
Ive been paid out twice for it now.
Even if it wasnt your fault it has to be declared on your insurance.
So will affect your policy not by much i would think.

Yh u have to inform your policy provider regardless of the route u take to resolve it

i was paid off more than once for one LUCKY car i had! to be honest the money was worth more than my car at the time and came in handy then. I didnt tell the insurance company as the damage wasnt big (rear bumper each time)
What damage has been sone and at what cost? are we talking £50 or £500?

do you have to inform the police within 24 hrs???? not sure can somebody confirm

my neighbour drove at the back of me i informed my insurance company and asked them to sort it out with the 3rd party,at 1st they said i had to resolve with 3rd party insurance i then claimed what do i pay you guys for and they didnt say a word but sorted everything out, i managed to get £250 and i got the job done for £30

These matters are entirely civil matters unless theres cause to suspect something illegal happening. If the guys hit you and theres substantial damage to your car then you should call your insurance company who will get on to the guys insurance company and get the repairs done for you.

If its minor damage or damage that you can put up with and wouldnt cause your vehicle to fail an MOT or be unsafe, for example a small scratch dent etc. then the guys request is legitimate. It may be thats its cheaper for him to pay you a cash amount rather than put it through his insurance.

In any event, its up to you, but if anything on your car really needs serious repair then I'd get quotes from garages and then settle it with the guy. Or if its minor then suggest a reasonable amount of cash that you'd settle for, but make sure its worth while or else just get his details and phone up your insurer, if its his fault then you will not be penalised and you will still get your car repaired.

Do you have his reg, if so go to [url]www.askmid.com[/url] and check he is insured! He may want to avoid it because he is not actually insured! If he is, then it comes down to him wanting to protect his no claims, Or maybe he has a high excess.

If it is only minor damage, then i would settle with him to pay the money for the repairs. However, if he is not insured, tell the police

If you are going to use your insurer in any part of the claim process then its part of their terms that you must notify them within a specififed time period otherwise they may not be able to help you, it doesnt say they wont help you.

This is why its important to evaluate the damage and get all details of parties involved along with witnesses done and dusted as soon as possible.

Well thats what i found suspect, he said he owned the car, but didnt have a english telephone number, just singaporian. and the address was his mothers! hmmmm

Thanks for all the help guys, I'm a little confused if i have to tell the insrance company or not. I dont want my premium to go up next year because someone hit me. Even though it was not my fault,

In terms of damage to my car, there is a crack in my bumper and thats all, the only thing that worries me is he had a 4x4 and one of those bar things on the front of his car, im going to get the car checked out tomorrow, i hope that there is no damage to the chais of the car.

of course, there is 2 ways to look at it. let him pay for damage (hopefully he comes up with the cash) and be done...or phone your insurance and the police and pray he has insurance and a license. of course now it may be too late for the police to do anything if he has nothing as you probably have no witnesses? personally i would have phoned police there and then.

Just checked and it seems the car has insurance, but it doesnt show if he is insyred on it.

you're premium wont be affected at all, neither will your no claims discount if it wasnt your fault. You may have a number on your insurance which entitles you to free legal advice or even on some other insurance policy. It'd be worthwhile just checking it out to reassure yourself. Cheers.

Did you get his full details- name, address, insurance company, etc?

This should be mandatory - if they can't supply the details, get your camera phone out and take a picture of them and the car (reg plate etc).

Bottom line is if you notify the insurance company (as you should be doing) and the other party have no insurance, it may affect your no-claims bonus.

hi,

my advice would be, if he wants to go privately then you will need to get a quote and he will need to agree the repair costs, and pay you first. if you speak to the garage they will take the payment direct from him by credit card save you waiting for a cheque to clear. the down side is this is make sure the garage include the cost of hire car while yours is in for repair as you won't get one other wise with out paying. also you will need to cover the car possibly on your own insurance. if you make a claim this would all be included by your policy.

as it was some one elses fault you could put it through your own ins, but may have to pay the excess while awaiting liability. you can claim this back once established.

if you have all his details you could call an acident management company and they will take care of it all for you, chase him, establish liabilty and arrange a hire car etc for you.

its always tricky when they want to pay for it them selves, especially as people are some times niave to the costs of repairs to cars these days and if hes not got the best contact details
