Help just won something on ebay!

Just won something on ebay. But the problem is that I searched for NEW items on the side on the ebay panel.

This item that I won said NEW in the item specifics but in the description is says used for 2 months as new.

Can the seller demand that I pay?

No there was no need to, since I only searched for NEW items.

It's a mobile phone - so at the top where it say model number and stuff it says Condition: NEW

If I open a dispute what will ebay look at? The item description or the item specifics?

Isn't this a breach of ebay listing reprenstation policy? The item was used but it was listed as NEW?

Even says in the listing: It comes in its box as new, but a little further down says used for 2 months.

i would first contact the buyer and ask to mutually withdraw from the sale, if you both mutually withdraw then they will not pay any fees,and neither gets a tick by their account, just explain you bid on it as it was stated as new, and you never checked the description,although i have to say i find it hard to believe you bid on something you didnt even bother to read, what if it was new but faulty, new stuff can be faulty you know

so im guessing it is not allowed but I find it heard to believe you didnt read the full listing, you gotta know what your bidding for especially mobiles. I remember watching judge judy and a lady was being sued cuz she auctioned her mobile phone but only sent a picture of the phone :thumbsup:

You don't have to pay ebay remove "As new" items as spam just contact ebay no worries. But its your own fault really not reading the listing first before you bought but in this case you will not have to pay.

Agreed, but pre filled info means nothing. Don't know about you but i'd like to see the item number to see how obvious it was that this was second hand.

The 'as new' was in the descritption, not in the title.

But what beats me is that it said new in two places - the item specifics and the description itself. And the third it said used.

I still want to buy it but maybe at a lower price, you think that will be do-able?

a) The Seller could not be bothered to list his own item for sale correctly therefore I am questioning my value as his potential customer and even the quality of the item.

b) He deliberately described his item as New to attract more custom and in effect generate a larger return.

Without looking at the item in question it's all meaningless speculation. For all anybody knows it could say.

People list things as new all the time, to get more views. Thats why ebay actually say its your responsibility to read the description fully. Just look at the amount of VHS videos listed under the DVD category with pre-filled info.

it's NOT prefilled - this is item specifics i.e. make model etc, you have to put this in yourself - including the condition of the item.

I would have thought that ebay care more about this becuase listings can be so ambiguous, whereas the item specifics is not - from a legal perspective anyway.

Anyone had any experience? Thoughts?

My spending limit for used and new is obviously different, but what I don't want to do is be completely unreasonable, if the seller is willing to accept my price (they are going to have to sell it again anyway), then I'm game. Once relisted the phone will sell for less anyway.

Ok, having seen the item, it 'seems' the seller deliberately sets the pre-filled info to NEW on his used goods to spam the search results.

Rash, it's a bit 50/50 tbh. You really should have read the listing properly and bid at second hand value. If you no longer want it, ASQ the seller and explain the situation regarding his search spamming etc (in a nice way) and ask for a mutual withdrawal and explain that if he agrees ebay will refund his fees etc. He can only say yes or no. I wouldn't ask for a discount personally as I agree with Waterloo, it just looks like either buyers remorse or you're trying it on. Regarding pre-filled info, I see you're not a seller so probably don't know that it's just a list of multiple choice boxes and they are quite easy to get wrong. Not in this case though.

Sorry don't agree with you on that,

Pre-filled means its already been filled in - in other words if I say I want to sell a Nokia N95 then the specs will be filled in automatically for example the dimensions, the fact that it's 3G, 5MP camere etc.

'Pre-filled pre-set questions' just doens't seem right.:thumbsup:

But that's how its defined in ebay terms as all the answers are 'pre-filled' insofar as you can't add new answers:lol:

Basically they're quick and dirty and rarely 100% correct ;-)

I would contact eBay as if they have a problem with people listing used items as new then they will cancel the auction and you will not be liable to pay anything

It's their responsibility to make sure that the listing is correct. If they think you're trying it on, then "So what".

Pre-filled looks nicer, but people need to be aware that these often contain items that the seller doesn't/never had.

Ah I see it's not quite clear what pre-filled and item specifics is, it kinda overalaps;

Basically just common attributes of things to save you typing stuff.

However the main point I was making was that ebay does NOT fill the the values, it is upto the seller to populate them.

So the seller knowlingly populated the field with the value NEW.

These are my sentiments exactly - but ebay does not populate them with values automatically, the seller does that.

i actually fell victim to the 'pre-fill' as i sold a phone without camera yet inadvertently pasted the text relating to the phone which mentions its camera .... (Nokia e50 btw ...) should get more relisted anyhow ;-)

Yeah contacted seller, sent me emails quite quickly but hasn't got back to me about my latest email.
