I bought an XDA from a ebay seller that arrived, however it was faulty and the seller asked me to return item and gave me a part refund up front, with the rest to follow after he recieved it.
I returned the item Standard Parcel insured to £100. however the seller SAYS it has not arrived.
who is responsible for claiming from the Post Office?

It was your goods that went missing.
You will also require the reciever to provide a statement saying they never recieved it etc.
Did you not have a tracking number?

I paid for extra insurance.
When you say nothing you can do, do you mean I should give him back my part refund he gave me? and take the full loss myself, or await the claim outcome?

refund his money, you took out insurance so you will get it back off royal mail

The item was £55 plus £6 postage, when it arrived it had tomtom satnav software on it, which I asked for the certificate to prove it was genuine, he never replied to my email, however I then found it wouldn't connect to any network and was clearly faulty. He said he'd bought it from someone else and never used it himself, looking at his feedback he sells loads of phones. He asked for me to return and he'd refund, I asked for a part payment, as I've been stung before on ebay, and he sent me £30
I posted last Sat (3/01) and he still hasn't got it, he says
ok, with hindsight I should've sent special with tracking, but I did insure it.
ps Do I need a statement from him saying he never recieved it?

If you paid for extra insurance, you should have a receipt from the post office stating this yes? I think it is just like a normal till receipt that you get when you buy something from a shop, but I think it has a code on it, eg. RM243-664-8823TC.
If you have "something" then you wait 2 weeks I think after the posted date. If it hasn't arrived, go on to Royal Mail website, and look for how you claim.
Then just take it from there. I wouldn't give him any money back at the moment. He sent faulty goods, so he should be prepared to wait untill you get your end sorted.
Once that's done and you receive your insurance money, which you will, then you just refund him the difference, so that it works out that you paid for the delivery, and he paid for the re-send, cancelling each other out, sorted :thumbsup:
