hi, i have sold a ACTION 52 megadrive cartridge on ebay, and it was one by someone.
Now this guy is refusing to pay because it is an illegal catridge or "back-steet and instanbul market" gear.

his arguement lies with that :

"Hi i was just about to pay when I noticed this is an illegal hacked cartridge and not a sega product. And ofcourse you can understand I will not be paying for an illegal item. I will notify ebay of the item If you choose to leave bad feedback. "

I explained that all releases on consoles are made by the makers, EG Action replay- that state on them they are not endorsed by sega, my cartridge is like this as it was sold in america for $199 at the time, and too states it is not endorsed by sega...it was even advertised in magazine and shops.

He then replies with
"thats not valid. Action replay Was sold in shops and was not an illegal product. your item is an illegal cartridge. Im not into your pressure type situation to pay style. lets let ebay know about this and see what happens then shall we..... If it was a legal cart it would be sold openly on the market. Your item is 'back-street istanbul' You are having a laugh trying to con people like this. please dont bother me again or I will take this further."


i then replied with:


you've either been informed wrong or your just wrong. as i said it is like action replay as it just isnt licenced my sega........... if you dont believe me look on http://en.wikipedia.org/wiki/Multicart its not listed in the pirated multicarts its listed in the unlicenced multicarts....so i think you will find i am correct...and im not bullying you into paying....feel free to get ebay in, because if you dont i will.

its a back-street illegal cart. This is bullying. not impressed with your attitude. If the item was legitimate I would have bought it. It is not though a recognised sega product....which makes it illegal. Action replay WAS recognised and sold to an open market. Please stop this now and dont bother contacting me again.

Did you send the item before you were paid?
You can ask for the item to be send back and cancel the payment.
Contact ebay and let them know he hasn't paid.

he should have read all the information first, I think he is in the wrong............. you didn't bully him, I think you were very polite.

he bought it with buy it now, then sent me a message the day after saying ...well the first message i posted.

At the moment we are not the best of friends, but i do not know what else i can show him as proof to show it was in the shops, magazines and is classed as legit

Sounds like a douche. Re-sell it, someone else will buy it who wants it.

i havent sent the item , he hasnt paid and isnt going to, and if i cannot even prove its legit with the facts(including all the links i have provided) then i am putting it to ebay on the 1st of may as a non payer, but even then i dont think they can make him pay.

i could and probably will have to....its just the hassel of the fees i have to claim back etc.....and when i listed it i didn't even know there were less than 10,000 of these made so i may even have to put that in the listing

Change your buy it nows to only allow paypal bidders, that way you won't get any spoilers.

Don't waste any more time corresponding either, move on and remember to Neg him, otherwise the feedback system is a mockery. If the non buyer negs you, don't worry, you're feedback should be clear and serve as a warning to his other potential targets.

even if both of yous do nothing you still have to file a non paid dispute otherwise you wont get your ebay fees back

If a non paying bidder gets the "non payer" strike against them and then tries to leave you negative feedback ebay remove the negative feedback, so you will be fine

I meant people reading your feedback will see the true story, it's not good enough not to leave feedback for 'fear' of getting a neg in return.

Jase.2 is bang on the money though. Report as a Non Paying Bidder, let them get the strike.

Open the dispute as above and when it gets closed in your favour neg him as well as he cannot neg you back if you've won. You will need to do this to get your FVF fees back. I'll be surprised if EBAY take any other interest in whats for sale etc.

just report as a non payer with ebay after 7/8 days i think..... then if he still wont pay, you will get your fees back after another 7/8 days he will get a non payer strike, neg him and if he negs you back it wont count as he was the non payer:thumbsup:

Wrong. As long as he responds to the dispute he CAN and no doubt will neg back.

Sod it, go for it. Sounds like a prize needle hole. (how's that for circumventing the swear filter :lol: )

But as he has said he is NOT going to pay then he will loose the dispute so if he does neg then it will not be counted

Yeah the fee's are a kick in the teeth and they only let you claim them after a few days because ebay say you should wait a few days for payment to clear etc. So ****! Why not sell elsewhere I know there is eBid or something

ONLY if the buyer fails to respond. I've done it loads of times to scammers/AH's and the only ones that haven't counted have been when I couldn't be arsed to follow through and contest the dispute.

Though it happens rarely, there are some circumstances when members can lose Feedback privileges. When a buyer doesn't respond to an Unpaid Item notification and the seller issues an Unpaid Item strike against them, the buyer can still leave a Feedback comment, but the Feedback rating they leave for the transaction will not appear and will not count toward the seller’s Feedback Score.

An eBay administrative note will appear under the Feedback comment on the Feedback Profile page, explaining that the member did not participate in the Unpaid Item process.

You should always respond to disputes opened within the Unpaid Item process. If you have resolved the situation outside of this process (for example, by making a payment by phone or email), please go back to the Dispute Console to enter a comment. Otherwise, you may lose your Feedback privileges for that transaction.

Note: When an Unpaid Item dispute is closed automatically, the buyer will lose Feedback privileges immediately. This happens when the buyer is no longer a registered user of eBay at the time of the Unpaid Item filing or is from a country to which the seller has indicated they will not post.
