Help on Private Parking Charge!

I have been issued a £60 fine from Premier Park when driving (legally!) my dad's car. There are 2 carparks next to each other - one for the leisure centre and one for the shops. I wanted to go the the leisure centre to get information on a children’s birthday party and to take my mother to TKMax to get a Christmas present.

Neither car park was full and neither car park requires a ticket. I therefore chose to park in the Leisure Centre car park as I find the spaces easier to reverse out of.

I went to the shop first and then to the leisure centre and on return to my car found a parking ticket.

I have heard that they can only fine the driver and the owner does not have to say who that was - but I am not sure if that is accurate and don't want to land my dad in it!

Can I do anything or should I just pay up and move on?

If neither requires a ticket for what did you get a fine?

Unfortunately the car park is not owned or run by the leisure centre but I like the idea!

For parking on their land and "leaving the site". The car parks are next to each other so I figured if your using both areas then you should be able to park in either - but presumably I should move from one to the other! There was no gain to me what so ever apart from an easier place to reverse out of!

Can you prove you was in the Health Centre/Shops? receipts, info brochure? If so ignore the fine.. If it's a private company there's not a lot they can do. They will phone asking for your credit card details. I usually wind them up and ask them who they are and to give their CC details to me..
They ask why. I say you want mine, I want yours. In the end say "There is NO chance of you getting my CC details as I don't believe who you are". I was at such a place for a reason..

They do it here when Wigan play at home they try and fine anyone on the supermarket car parks..

Did they film you then?

Hi - Thank you! I have read it and it looks like if it wasn't the owner driving they can't do anything, however I spoke to my dad (far too law abiding!) and he said he would be worried not to pay the fine in case it had repercussions and we ended up paying more - bless! I will see if I can find more info on this - thank you. Debs

They have a man in a little white van who watches everyone I have since been told! I am just miffed - I know its on my head - but I wasn't trying to gain anything and don't feel I have done anything wrong - apart from probably not moving the car and using both sites!

If the ticket was issued from a Private Parking Company, you can just literally ignore it, as they have no chance to pursuit this charge.

Was there a sign mentioning this?

There is a sign saying you can't park unless you use the premises and that is in both car parks - I had a niggly feeling when I parked but shook it off!!! Should have just gone to the shops like my mum wanted and gone to the leisure centre another time - trying to fit in too many things!!

I still wouldn't be bothered since the time and costs bringing a case against you in court on something they wouldn't be guaranteed to win would probably not bring enough reward to offset the negative publicity they are likely to receive. Anyway didn't you use the premisis when you went in there to gain information.

I would suggest if you used the centre while you were parked on that occasion, then you did park to use the leisure centre and were therefore legally parked. Your route to the leisure centre is nobodies bussiness but your own.

If the restrictions are that tight that they do not allow you to step off the property of the car park and leisure centre at any time while the car is park this shouldb be specifically and clearly stated on signs around the car park. I would even go as far as to say that a clear line should be marked on the floor all around the land owned by the leisure centre to make it clear where you are allowed to walk while parked.

Clearly this is ridiculous and so is the idea to fine you because you popped to TKMaxx.

Thanks. Have decided not to pay and convince my father it is a good deciscion! Not sure if it will come back and bite me - I found an artical on Premier Parking where they fined some members of a band who were doing a charity gig - they refused to waive the fine which was £400 and the money had to come out of the £4000 raised - disgusting!

Thanks for all your advice - I shall be checking up on the links you have sent.

It's all well and good everyone saying don't pay it and you are probably right in what you are saying but I'd be worried there would be a knock at the door one day with a mahoosive bill 10 times what it was originally.

The ones where you see a knock at the door with a massive bill are ones from the councils that have already been through the court system and hence have all the fees associated with them. You may get someone coming round claiming to be as such then you would just call the police and get them arrested for harrasment as they would be unlikely to hold a warrant

They cannot force you to pay but they may stop you from using their car park in future,

DONT pay, ignore, youll hear nothing from them again ! Simples !

Correct it just a shame most people do not know this or are to scared to argue with them as they are bullied into paying by these scumbags who lie and have even been known to set you up to get a parking ticket.

Couple of years ago I was cleaning out box of paperwork and found a parking ticket I got in our local shopping centre. I never paid it - solely because I totally forgot about it and I havent ever heard anymore about it. Was a private company too that issued it
