Help regarding partial refund/faulty product

*This is on behalf of a friend who has got into some problems, so i only know what im saying in this post*

My friend purchased a quad from a small company in Milton Keynes back in June. Fast foward a few months and it picked up a problem with the motor and he contacted them and they sent out the part they thought would fix it. This did not fix the problem and over the case of a month or 2 the problem was never resolved. The company then stated that he should take it to get repaired and he then stated he had enough of the problem and would like to return it.

The company then told him that all they could give him was £2100 (The quad was purchased for £2700)

Obviously thats a fair chunk of change to lose out on. He then contacted the CAB and they told him there was not much they could do, and just to write a letter to the company of purchase.

He has also tried the bank, but they also told him there was not much they could do, due to the fact it was purchased via "Debit Card"

Should he just cut his loses and accept the £2100 ?

Did it come with any warranty, if so what were the T&C's.

Can he prove (by getting an expert to evidence this) that the product was inherently faulty?

Just take the money, not worth the hassle.

It has a 12 month warranty. ( Will ask him if he can provide T&C's )

The bike has been returned and cant be taken to get evidence on fault.

Excuse the lack of info - Please let me know if there is anything else i should get from him.

So your friend has returned the bike and they say that they will give him £2100?

As they have had some use out of the item they are not entitled to a full refund they can offer a pro rata one (how you work this out i dont know)

Any shop could potentially do this and its not illegal although not may do.

Saying that they have had it less than 6 months so its deemed to have been faulty from day 1

Do they have legal cover on house insurance ?

Have you tried posting on MSE there are some good people on there with pretty good advice

Wasn't sure just thought I'd make sure.

Serious advice has 12 months warranty it's there problem or you can take them to court and regain the full amount.

Just spoken to him again. 6 Months warranty. The company told him that they were going to email him today with the partial refund details and a list of reasons why they would offer full refund. They also told him what the problem was with the bike over the phone ( manufacturer fault) and that they can only give him £2100 back because thats all they will get from the resale, and that they cant get any money back from the bikes manufacturer.

Why not just let them repair or replace?


They sent out loads of diff parts and it didnt solve the problem. They also stated they would not cover the cost of a repairer. He just got peed off and told them to come a collect it.

fraid he is up the proverbial creek having returned it, the company will argue the VATable content of his purchase(nearly £500) and that the refund is essentially his money back minus the VAT
