Hi All

I would really like your help on this one please.

I purchased a pair of Timberland boots for my husband from E Bay they were listed as genuine but when they arrived they were really bad copies clearly fake,i even took them to a Timberland stockist to confirm,they laughed.

I mailed the seller who said he did not know as he got them as a gift,which i find hard to believe as they were so bad,Anyway he said to post them back and he would refund me.
They cost him £4 to post and he charged me £10 which i feel was way to much.
Sent them back 1st Class and got proof of posting,still nothing so as i paid pay pal i opened a dispute he has told pay pal that he hasn't had the boots back and that as far as he was concerned they were genuine.

Now pay pal said the only way i can get a refund is to prove to them that the boots were fake and it has to be on letter headed paper from a specialist stockist stating why they feel they were fake,since i no longer have the boots i can only go back to the shop i took them to but i cant see them writing me a letter and to be honest i feel a little cheeky asking but what else can i do ?

Any ideas please ?

Sorry but many mistakes have been made and unfortunately it is unlikely you will see anything back.

You shold have returned them recorded for starters, he will just deny receiving them.

You shouldn't have sent them back before opening the dispute.

You should have raised your questions on here before doing anything.

If he says he didn't receive them back there is little you can do.

Try the shop for the letter if you see the same person and they remember you they may do the letter, especially as he selling fakes and not doing Timberland's name any good. They may even take it further for you if he is selling a lot of them.

How about contacting head office for help?

you should have escalated to ebay straight away... put some super bad feedback on his account and if he has anymore goods that could be fake tell him you are going to report him to the police and trading standards.

you should have sent them back recorded tbh.

I know it was pretty stupid thinking of it now but i felt bitter him overcharging me loads for postage and didn't want to be out of pocket anymore than i had been.
This is why i just obtained proof of postage,yes i could kick myself now.

I don't think you could even caim for compensation from RM on a fake pair of boots.

I do feel so angry because i know he is lying but i cant do nothing Arghhhh

Tell him you have a raised a compo claim with the RM which may involve them contacting him, it's worked for me in the past.

Thank you both for your help,i may have a go doing that tomorrow,its worth a go i suppose.

How much did you pay for them? If you got a receipt for postage you are covered up to £34 I think on 1st class. The Post Office can also check if the item was delivered, and if not, you will get at least £34 back from them. If they say they have been, he can't say that they weren't. Did you take a picture of them? You could take the pictures back in to the store that you took them in and talk to the guy, or the manager, explain the situation and show him the pictures, he will probably type you up a letter so you can send off to PP. Stick with it! :thumbsup:

Rehydrated made a very good point.... if this ever happens again take pics to prove to the seller that the goods are fake.. if the selly does not agree (through ebay messages not personal emails) then escalate to paypal BEFORE sending back... I know this can't help you now but may in the future....

I bought a pair of DJ heaphones off ebay and they were good but I could prove they were fake in pics so I emailed the seller who agreed to give me a full refund and let me keep the headphones! which I am listening to now!

You can do something if you paid via you credit card in paypal,I ordered a Fire that took ages to be delivered with little contact given so complained to credit card company who asked for evidence - invoice ,email etc, and eventually they issued a charge back from the person involved, I always pay this way now, Hope this tip helps someone.

Well thanks that's a good idea i will go back to the store and ask if they would be kind enough to write me a note on headed paper,i think they would probably charge though.
I didn't take pictures but will do if anything happens again like this,but i may go to the listing and copy his picture.

Sadly no credit card my pay pal is linked to my bank account but think i will change now most definately.

they wont charge you.... if you see the person you showed in the shop then ask them to get a manager and then explain the situation to the manager infront of the staff member that saw them. they will be happy to draft something up. be assertive and dont go in a way that you are putting them out as then they will make an excuse not to help.
