Hey, I wondering if anyone could help me out or offer me some advice, I sold a mobile phone on ebay at the beginning of February and the buyer has contacted me today stating that he/she is currently having problems with the mobile phone, a couple of days after sending the phone the buyer re-listed the exact mobile phone on ebay, probably the one that I sold them. Now the buyer wants a refund and I really don't know what to do, I sold the phone brand new and sealed and just stuck as what to do, I don't want paypal making a chargeback to my card. Has anyone had any problems similar to this before and what was the outcome?

they have 90 days to make a dispute thru paypal mate, did you get a sig for delivery?

I would initially ask them what the actual problem is with the phone, it seems that they may have sold the phone to someone who in turn is trying to calim a chargeback from them,

Hi buddy, i dont think they are claiming for non delivery, seems like its a faulty phone dispute, they have confirmed delivery by disputing the phone has a problem

Yea, I sent it recorded delivery I will have to dig out the receipt :)

Yea the buyer is claiming for a faulty phone, the buyer received and left positive feedback

This doesn't matter they have already confirmed delivery by complaining that it is not working

as you sold it brand new, they shouldnt argue it with you .... but this is ebay ..... get a fault from them and google to see if its a common one,

Send them a polite email asking them what the fault is, one of the main reasons people get neg on ebay is that the seller jumps in & peeves the buyer, try

Dear ......

Im sorry to hear that you are having a problem with your .........., if possible could you let me know what the actual problem with the phone is,

As im sure you are aware the phone was dispatched brand new & sealed & there is no way that i am able to test the item before it was posted,

If you could let me know as soon as possible then im sure we can resolve the matter,

Buyer can only file a paypal dispute within 45 days

Then can only leave feedback for 60 days

Don't think you have a problem with any of the above.

The only other thing they can do is try a chargeback if they paid via a CC,i would have thought that was unlikely though.

oops my bad deb8z is correct 45 paypal and 90 with cc chargeback.

i would send note like mike says and see what they say and take it from there for the moment

Some banks allow you to chargeback upto 6 months.

See what reply you get back but I would be tempted to mention the fact they have sold a phone the same as the one you sold to them.so they know you're aware of that:thumbsup:

it must be pretty close to the 45 day deadline as well from begining of feb....

maybe worth giving paypal a ring and get it on record and ask their advice......sometimes they can be helpful in situations like this.....

i managed to get them to investigate a buyer claiming not authourised and they found hed just logged in on same pc same ip address and cancelled the claim

Please tell me you kept a record of the IMEI for reference to show its the same phone?

if it has been 45 days since you sold it, ignore it.
there is nothing they can do. you don't need to be hassled by it.
I mean its a hell of a long time since sale to be claiming problems.

Received a reply from the buyer today, he tells me the phone keeps on freezing and switching off.
I think I am just going to ignore him as I sold the phone brand new and sealed and it's not my responsibility.
I will also contact paypal tomorrow and see what they recommend.

i think your buyer is trying to pull a fast one ,my friend had this thing befor .they buy the same item ( new ) and claim its broken ,then send you there broken one back for a refund.
you must tell them you keep a record of all serial no.s , imei no.s for the phone ,which must be verifyed befor any claim for a refund is looked into.
try this if they keep on at you , if they are trying it on ,you wont here from them again.
