Help with eBay item

Hi all,

I brought a Blackberry from a chap on ebay. Item No 130461995039 (if you want to look).

I know I should have checked the phone out fully but it looked OK from from the outside. However it has clearly been taken apart lots of times and only has 2 screws holding the insides together. There should be 6! as you guess it does not work!

I have emailed him and he has said no chance of refund. I have opened a dispute with ebay and paypal but I don't hold out much hope. It was £150! Its not the money its the fact that my son is heartbroken.

Any advice????

you'll get your money back... ring them if nevessary to explain the situation and they'll definitely take more notice and side with you

yeah i'd take lots of photos - especially seeing as they used a stock photo not actual representation, and i'd ring them - thats what happened to me with a dvd player - the seller said i had no hope of getting a refund, ebay gave me a full one after i'd phoned them and paypal

also when you send it back ,send it special delivery. otherwise you prob end up losing out.
you should get your money back

Are you basing this on his ebay photos? If so thats a stock image.

Unless someone is a proper ebay trader and the items are new and boxed then I wouldnt touch a used item of any real value without seeing proper photos of the item.

I didn't mean it in that way, it was just advice as its £134.95 For the curve BRAND NEW :) merry christimas.

The correct course of action is as follows:

Put in a dispute with paypal and immediately escalate to a claim as this will put the funds on hold in the sellers account

Take photos of the phone including the imei number etc

Wait for a response from paypak which should be to return to seller

Return to seller by special delivery

Add special delivery tracking information to paypal claim details

Await refund

Any hiccups on the way call paypal up,do not take part in any other dialogue with the seller outside of the pay pal process

You should get a refund without issue

If the seller offers a refund if you close the claim to unfreeze his pay pal account then tell him where to go,this is a common tactic

@Harizter.. You are correct. However I did not check it worked or inside the case. The chap has a good rep and I have never had a problem with any item before from ebay.

I know I should have checked! could kick myself!

Yes, tell ebay/Paypal that the feedback was left in error, was meant for someone else.

did you pay via paypal and then meet up to collect the phone since you say the outside of the phone looked ok? or did you mean it looked ok after you took delivery?

I don't think there is much hope as you left positive feedback for the seller.

How did you fund your Paypal account ? Was it via bank or card options ?

Feedback means nothing, in fact the feedback you left doesn't mean the item was excellent it could just mean the P+P. A SNAD should easily go in your favour if not a chargeback definately will cause paypal do not contest CC chargebacks for SNAD items assuming you di pay by Credit card would always advise this for items over £100 cause it gives you another avenue of protection.

LOL..but how does CC will take the chargeback for that ? I thought only on non-receipt of the item or it is a fraudulent transaction.

If I were the OP, I will just raised a dispute, send it back doesn't matter if seller happy or not, keep the receipt of posting. And then contact the CC company said you have paid, item not as described, and then have returned to the seller. And then the seller has NOT provide a refund or refuse to give the refund

You have more grounds to contact CC on this, cause once you do chargeback via PP, your PP account will also be suspended too
