Help with ebay seller

I bought an item on ebay. the seller says he sent the item Royal Mail Special Delivery. Looks like he sent that message on 31st Dec but says it 'should be with you tomorrow am'. I kinda thought he messaged later than he thought cuz that makes his delivery am on 1st Jan.

Sooooooo

So no show and a couple of requests for the tracking number and he comes back with a tale about getting stuck in Saudi and a tale about 'scanning the receipt' to email me. Still no tracking number.

Smells worse by the day.

Anyway if no joy tomorrow will start proceedings something by way of ebay/paypal and small claims in local court. but this is what I'm stuck with

I don't know what I should do. The Buyer Protection Page is 404ing ( http://pages.ebay.co.uk/help/buy/buyer-protection.html so i'm in the dark) We are talking ca. £100 for the item purchased by PayPal on 24th Dec. Item was one of 3 sold on the day and there's still no feedback from the other buyers.

Its nearly my bed time. I will be about and will come back tomorrow...I always appreciate help.

Preferring not to fire up IK info. although he's about 20miles away from me according to the auction.

Thanks. Why do you say that over ebay dispute? (updated OP to say the PayPal Protection page isn't showing - so i'm in the dark)

You paid with paypal so just makes sense. Have never filed any disputes via ebay directly before always via paypal. Just state you haven't received goods, is then up to the seller to prove delivery which by the sounds of it they can't.

Sorry, what I mean is open a dispute via ebay account but is a paypal dispute!

I'd start an ebay dispute rather than paypal as I have found them more helpful in the past and will refund even if the seller doesn't have the funds in their account whereas the paypal dispute will only refund you if they can recover the funds. This is from past experience, it might have changed since then but I'd start an ebay dispute.

As above, I think if you use the 'resolve a problem' option in Ebay it covers item not received.
I had to do it with some robbing git, it took a little while but my Paypal payment was refunded.
Just keep it friendly with the problem description as they seller will see your reasons for the dispute.

Thanks for your reply. Yeah I was just thinking that cuz if I were a dodgy seller I'd decouple my paypal account from any available funds. So you reckon ebay have greater powers to refund ? I just don't know what powers any of them have and am after a bit of guidance.

Before you do, food for thought, you need to take into consideration the bank holidays and weekend, no delivery on 1st, 2nd or 3rd which leaves it as today being only the 3rd day in transit.

Also, i'm sure the receipt the seller 'has' should have the tracking number printed on it!

Good luck, i'm still awaiting a parcel that was posted 21st Dec... :(

Yep, start the dispute with ebay tonight, then remember you have to escalate it within 10 days (I think) and follow the instructions.
Sorry you have been scammed, horrible feeling but you should be ok. Just complete the dispute forms and you should have a resolution within two weeks,

I know what your saying but am getting uneasy with various excuses why such n such didn''t happen and surely easier to give me the tracking code than come up with another delay and reason ie it needs scanning. And his comms did say it should be with you tomorrow which would fit with sending it the 30th (giving him the benefit of the doubt he confused his days). That's why tomorrow is crunch day..item or tracking code to be in my posession.

There are probably a few ways of starting a dispute.
I think I went into my won items and on the right hand side where it says leave feedback, below that it there is a more options, resolve problem is one of them.

Not sure you can open a ebay claim in such short time as they tell you you have to give so many day for the parcel to turn up.I would do a paypal claim but would wait until after 1pm Tomorrow before doing that.If he's not given you a tracking number then you would have to wonder why.
As buyer you will get full refund from paypal so nothing to worry about.

ive done disputes with both, and found ebay alot more helpful than paypal - i found a phone number for ebay online (and they give u one now in a dispute) and the guy on the end of the phone instantly refunded me after i'd waited the period it had stated, whereas i've had problems with paypal - who kept referring me back to ebay...:/

Thanks to all. It looks like there is no clear cut winner. One thing I thought about was delivering comms to the group I chose (PayPal or ebay) do ebay have immediate access to your messages? That would make it a lot easire if they could look for them selves that my word is good.

Was the PayPal claim problematic for a reason eg complicated ? And ebay gave you a full refund did it cover postage - was charged £8 for Postage here.

yeah ebay covered the full amount - and postage for me was £8.00, paid £18.50 total...got £18.50 back and was told to keep item/throw away or whatever :) was dangerous so it went in the bin but ebay were alot faster dealing with my problem

OK think I'll go via ebay. Most of you have mentioned that ebay has been good in dealing with claims. My sister says she's done this and then escalated the claim to PayPal...so i make that having two bites at the cherry?!

if you try do both - paypal close their end of the claim and you can't re-open it via paypal - so just stick to ebay good luck!

Ah well its done. Didn't know if it was like Dragon's Den (you need all the case 'requirements' to be met or there is no resolution) because I added payment for two hours of my time. Took it off incase it just hinddered things.

Maybe. They did message me on the day they thought I'd opened a case against them. I think someone else had done and they got confused because I hadn't. Anyway..no confusion anymore...case opened.

Blimey nanny immediately I get this message

""The lens has been sent, but to my error with no tracking code and only first class, unfortunately my sister posted it for me and I only have the reciept from the post office to say it has been sent, I am working in the middle east and cannot get to my computer everyday. Funny he only now mentions it was never sent with a tracking code and not the Special Delivery next day on the auction.. An Ha! He is concerned I won't return it. How about getting it first buddy.

He has no tracking number and has to prove you have recieve it which he is unable to do paypal will find in your favour maybe the weather or royal mail has held it up, also did you pay extra for special delivery? got to the computer as soon as you open a dispute getting fishy.

Nope, no tracking number. Expalins his poor comms on being in saudi (because they mustn't have pc' there) and refuses to give refund because i might keep the item and yes his auction had plain as day Royal Mail Special Delivery (TM) Next Day
So this ws my instant reply

YOU are concerned about me! I am not the person requiring 3rd party intervention for you to actually change your story: A) You didn't use the delivery you charged for B) You didn't use the delivery you stated on your auction C) You did not use the Delivery you continued to state as a matter of fact in your ebay messages "It should be with you tomorrow a.m." D) Something you continued to perpetuate by not telling me there was no tracking info when I enquired about it 3 times.

You continue to muddy the waters by saying you will send the reciept to my email. I have asked specifically for you to cc to my ebay messages. As you know full well my email is not open to ebay scrutiny. As you likely know using a standard service, proof of postage is not proof of reciept either.

You had a duty of care to abide by your auction to ensure I recieved my property. So far you seem to have shirked that responsibilitiy and been very underhand in the disclosure of info I have repeatedly requested.
