You don't need to worry about jargon when dealing with Trading Standards. Try phoning or visiting them & explain the story. If you can't then by all means write to them, but just use plain English & explain as clearly as possible what you want to tell them. Their job is to listen to the public & 'translate' the situation into its legal context.

ooops sorry i meant toys r us, i have been intouch with trading standards and now have to write to toys r us with details of what has happened, but as i clearly dont know what the problem is im finding it hard to get my case across:oops:

so afr i have knocked up this, but it sounds like i dont know what im on about (yes i know i dont, but would like to sound like i do)

Following our telephone conversation today as requested by yourself i am now putting it in writing for you to deal with.

Sale of Goods Act 1979
On 24th March 2005, I bought a Medion laptop from you for £799.00 which is faulty.
The problems are:

1. On the20.03.06 it went back to medion under warranty due to the usb port becoming loose, the motherboard and keyboard where replaced by medion under warranty

2. Four months after this the battery packed in and medion refused to do anything about this as claimed the warranty was up and battery life is not covered on the warranty even if it had been in warranty, since then i have used the laptop on power lead. *

3. On the 12th November 2007 the laptop blue screen of death appeared and closed down the system. on restart it had wiped the computer of everything on it, i have reformatted the laptop and reinstalled windows and all drivers, but this has not solved the problem, the laptop is still dying, i do not know where the problem lies and have been adised by trading standards to not take it anywhere until i have heard your response to this letter

Under the sale of goods act i wish you to repair this product. if unable to repair then i would like a like for like replacement
Please respond to my complaint within fourteen days.

hehe glad my previous comments gave you food for thought!! :)

a little tip when i spoke to trading standards about my lappy they said to actually give details of the sales of good act altho its obvious it just backs up that you know what your talking about and gives food for thought!

EG. according to the sales of goods act 1979, goods must be as described and of satisfactory quality, due to the following reasons i do not believe this laptop is of satisfactory quality......

also include any repair notes you recieved from your warranty if you still have them (im assuming just the one) to support the claim or youll probably find they will write back requesting it anyway.

Dear Toys 'r' Us,

I have spoken to to a member of your staff with regards to a purchase I made form your store. I was advised to write in to yourselves so that I can make myself clear and you can understand the problem I am having.


I purchased a Medion laptop from your ......branch on 24th March 2005(Copy of receipt enclosed).

I was having problems with the computer for a few months, but finally had to return it. On the 20th March 2006 it went back to medion due to the usb port becoming loose, the motherboard and keyboard where replaced by medion.

Approximately four months after this, the battery packed in and medion refused to do anything about this as claimed the warranty was up and battery life is not covered on the warranty even if it had been in warranty

Since then i have had no choice but to use the laptop with the supplied power lead which defeats the purpose of having a laptop, as it is not portable like I intended to use it.

On the 12th November 2007, I have now had a further problem.

When switched on, I just get a blank screen, I have lost all my files on the computer.

I called.......and was told to reformat the computer and reinstall the operating system and the drivers. I have done this without any luck.

I called the trading standards office in.....and was told by Mr/Mrs........ that I should contact yourselves as under the 1979 Sale of goods act, a laptop computer purchased at the price I paid (£799) should most definitely last longer than the 18 months that I have had it.

They went further to tell me that I should deal directly with yourselves, and not be passed onto the manufacturer, as my contract is with Toy 'r us and not Medion.

I am led to believe that the sale of goods act has a limit of 6 years from the time of purchase, so not to be persuaded about the 12 months warranty that the manufacturers give out. This does not supercede the statutory rights that the S.O.G.A gives me.

I understand that I am out of the time limit to reject the laptop, so either require my laptop repaired, or a replacement of an equal or better specification.

I require a response from yourselves within 10 working days from the date at the top of this letter.

If I receive no response I have been told to contact Trading standards again for what action needs to be taken, but this should not be necessary as you are aware of your obligations.

You also need to add your reasons fro claiming repair under SOGA.

ie Because it has had to be repaired numerous times, there clearly are manufacturing and component faults in this laptop and that you would expect a laptop computer costing £799 to last more than 2 years. ie The laptop is not of merchandisable quality.

Why are you sending it to trading standards? It needs to be sent to the shop you bought it from - but cc it to trading standards as well so they can see you have done so.

Don't worry about the rep :whistling:, I am just glad that I was able to help in some way.

You will probably get a negative response, and have to theaten court action, but we can deal with that when/if it happens. :)

What happened about your friends T.V?
