You should have a cooling off period. Read the paperwork and it will tell you how to cancel. :)

you usually have a cooling off period normally 7 days, phone them tomorrow and just say your finances have changed, so you don't want the sofas anymore, it should say on your contract with them about the cooling off period, i think you get it with any finance now

As with most finance agreements, you should have a 'Cooling off period' which allows you to cancel within a certain amount of days.

Check the small print on your finance agreement & you should be able to call & cancel I think.

Try that, other than that, I dunno! Good luck.

Just call them tomorrow and cancel

You should have no probs

Cheers

as above there is usually a cooling off period good luck and keep us posted on how u get off

You must return the contract to them and sign to say you wish to cancel, if they want you to post it, keep a copy and send it recorded, it is worth it for peace of mind and proof if you need it. The la is quite specific (at least 7 days cooling off and you can cancel but it must be in writing).

unless it is documented, you have no right to cancel a finance agreement if you signed it in store in the presence of a sales advisor.

There is no statutory right to a cooling off period sadly.

I would just tell them you dont have the money to pay, and advise that they cancel this contract because you will not be able to pay. Then, write a letter documenting this to dfs head office.

If they ignore this letter, I would say they would be classed as a irresponsible lender.

Consumer Credit Act 2006 will detail your rights.

http://www.oft.gov.uk/advice_and_resources/resource_base/legal/cca/agreements/

DFS tried to shaft my mum but when I found out we immediately contacted the store manager and used the irresponsible lender trick.

thanks for all your help. i have read through the contract for the finance with black horse but it doesnt say how to cancel at all but there must be some way..im sure dfs get this alot.

If the store won't play ball you have the fact you took finance on your side. The finance can't be activated until delivery, so if you refuse delivery.........................

not quite we ordered our sofa on the 31st of dec last year. Bloody thing didn't arrive until the end of april. payments started on the 31st of dec this year

If it's a deffered payment option, which it sounds like yours was, thats deffered from the date of order as by then you have delivery.
If you start paying straight away with no deferred period, the finance cannot be activated until delivery, if that makes sense.

ahhhh see now that makes more sense

doesn't matter stupid thing is paid for now :)

Er, you spend the best part of £2k without even a minute's worth of market research first? Jesus. This is why whenever you go shopping for anything of any value, you've got to agree with yourself a date when you will finalise your decision and make your purchase, and not buy before that date for any reason. The idea is, you see, it gives you time to weigh up your options, and it makes you immune to impulse purchases. Yeah, it means waiting a little while longer, but sometimes, you've got to surpress your impatience a little. Learn to stay in control of a sales situation. The power's on your side. Try and be more patient and deliberately delay yourself and hopefully in future you'll not get suckered in like this again.

I got two recliners from DFS, didn't have the deferred payment and started paying before my sofas arrived. There was no cooling off period as I had signed in the shop and a cooling off period doesn't apply when you go to a shop and take out finance there, it only applies to sales in yuor home and certain online purchases.

i have a feeling im gonna be stuck with it...i do really like the sofa but would rather have another and save 1k!! its my own fault for getting sucked in to it..im an adult and i signed the papers...just will think more next time i go into a legal contract!

just call Black Horse tell em you were pressured into the sale and explained to the advisor you would be unable to re-pay, but the advisor was persistent and said whats the worst that could happen? you miss a few payments etc etc.
Anyway tell black horse there is no way on earth you could ever make the repayments.
good luck.

couldnt do it guys..they wouldnt let me..not even few hours after i signed ...still like sofa just wanted cheaper one...nevermind...will think next time before sales guy bites my hand off.

I would still complain to the finance company, saying you were forced into it. Its not fair that you cant cancel it. Fair enough if you took the item out of the store that same day, but the sofa you have bought has not even been made yet. No skin off their noses. Just out there to make as much money as possible :(
#23
The delayed delivery is probably because many DFS Suites are made in China these days.
#24
DFS=Delayed Furniture from Shangai!

i also have this problem with dfs and the finance got declined but they saying i cant cancel the order so what can i do as they want £217 up front and rest on delivery

Tell them to get lost. They are trying it on not to lose the sale. Just tell them the purchase was subject to finance which has been refused, so therefore no purchase. They can cancel and do have a window to allow for this, the order is not put through until the finance has been accepted.

Tellt hem you will also report their heavy handed tactics to trading standards.
