Just so people know i wasn't speeding intentionally i was on a dual carriageway and the speed was 30mph not 40mph as was shown the week before. The signs were not clear at all as the signs from the previous week were still up.

Easy mistake so please don't patronize me with you should not have been speeding..blah blah blah

Rappy's right! Pay up, slow down!

dont speed in the first place or slow down when you see those big yellow things on grey poles

Just pay up, speed limits are there for a reason.

Speed Awareness course if you dont want the points or accept them like a man. Unless you can afford the fancy lawyer the celebs get to get them out of speeding in their sports cars
banned#8
another idea ... dont pay.. wait for the court summons.. go to court .. then pay extra rather than the £60 .. easy

Dont help him, he's commited a crime and you would be helping him worm out of it

Go here:

http://forums.pepipoo.com

The users on that site know traffic law extremely well, I'd definitely recommend posting your case there. There's strict laws on the signage for speed limits which there may be an error with or may not but it's worth a shot.

bob, dont know of any that actually work, I imagine the process dept have heard them all, calibration request etc. You could always go to court and try your luck. If you lost, the fine would probably go up though

everyone makes a mistake, im sure everyone is guilty of going a bit too fast when they are not supposed to x

The JFK
Everyone needs to stop jumping on the OP's back.

I always speed when I'm in my Beemer. On a 30mph road I usually hit 60mph. On the motorway I always get up to atleast 120mph but normally a lot more than that. If I'm drunk though I only drive at a max of 100mph 'cos otherwise it's probably a bit dangerous.

your an idiot the op has made a mistake due to such road markings being wrong, you are bragging about drink driving hope if you kill yourself you dont take a innocent family with you, as if you have a car anyway more like a carp bmx lol

Train Driver
You go to school on the sunshine bus JFK.......I doubt that does 120 MPH:?

Get photographic evidence of the conflicting signage as soon as possible before it is corrected. Conflicting speed limits cannot be enforced, because, as you have shown, people are confused as to which one is valid.

People on their high horses on here may have a point when there is only one speed limit, but when their are two options, things aren't quite so clear.

Any other help will be much appreciated:)

Everyone is so quick to jump on the OP but if indeed there were signs stating a speed limit of 40mph, then surely the ticket would be debatable

Correct - for a 30mph limit to enforceable it must have a set of lit 30mph terminal signs followed by a regular system of streetlighting or if there is no lighting then there must be 30mph repeaters.

Don't use template letters - while there are companies advertising this type of service they should be ignored, there is no standard get out of jail free card. If you want to avoid getting the points then your case is going to be based on a specific set of circumstances which are mostly unique. At worst I've actually seen these template letters get people into worse trouble than speeding as people have been pulled up for failure furnish instead of the original speeding charge. This is a hefty six points and a much larger fine which unless there is good reason for it (using template letters isn't one) then it's very difficult to defend against.

Doesn't matter, you still can't be done for speeding if there were 2 road signs.

Wrong on both counts i'm afraid. Speed limit signs do have to be lit, apart from 30mph ones. Also no repeaters are required for a 30mph zone.

I'm not wrong, you've misread the post - 30mph terminal signs must be lit (which is usually by the street lighting itself thus meeting the 'clearly visible' requirement) and repeaters are required if there is no streetlighting:

14.22 Where a 30 mph speed limit is imposed on a road without street lighting, it is necessary to make an order. In this case 30 mph repeater signs must be provided (direction 11(2)).

btw, as for this rubbish about it not being clear... if it really wasn't - then goto court and fight your corner. If you are just too arrogant to admit you cocked up, learn how to accept that fact, and pay the fine.

I am 99% sure its the latter.
#28
do you know for sure what your punishment is yet ? i was 6mph over the limit and got a letter just saying to be more aware of my speed in future
#29
Yup, I agree - if ou don't obey the law you should expect to get stomped on.

BUT

The police and the courts should also obey the law. Simples

They should obey the law to the letter, since they're administering it.

If they've put a foot wrong then they're just as much in the wrong as you.

Sure, two wrongs don't make a right, but of they've fouled up, then it's as tuff on them as it could have been on you.

Find the chink!

PS I was gonna say about www.pepipoo.com, but someone beat me to it.

IM TALKING ABOUT COMMON SENSE A NORMAL PERSON WOULD SLOW DOWN INCASE THE AREA LIMMIT HAS CHANGED AND NOT "CAN I GET AWAY WITH IT BOY RACER ATTITUDE"DONT PUT YOURSELF AT RISK AND CERTANLY NOT OTHERS ITS JUST NOT WORTH IT

You're not talking about common sense, you're talking nonsense - the rules on speed limits are very strict for the precise reason people need to know what speed they are allowed to do and why speed limits cannot be enforced if there is any error in the signage. You can't creep round the country's roads at 30mph in the offchance the speed limit has been changed but they haven't updated the signage correctly. If indeed as the thread creator has said there are either 40mph terminal signs or any 40mph repeaters then they cannot enforce the speed limit as neither of these are allowed in a 30mph limit. It would be common sense that if you saw 40mph signs and repeaters and were not aware of any speed limit change that you'd continue to drive at 40mph.

However if all the signs are marked up clearly then unfortunately it's going to have to be chalked down to experience not to do so again, obviously redoing the route as soon as possible and getting a passenger to take picture or film the journey to check is the best way forward.

i can understand where op is coming from, near to us, there's a dual carriageway where suddenly the speed limit goes from 60 to 40 and the camera is right on the line of change.. if a new person came into the area, they'd get done easy peasy.. good luck to op. one can only learn from their mistakes (only if its a genuine mistake, mind)
