I bought a stolen Iphone

apdukapduk

Hi all, im really peeved at the moment. I bought a iphone 3GS about 5 months ago now which was locked to orange. I imediately telephoned orange to ask for the unlock code, (ive registered the phone with them, and with apple etc when I got it). Orange told me I had to be on their network for 3 months before they would give me the code to unlock it. So i bought a payasyougo sim and used the phone, no probs. so 3 months arrived and went but they still hadnt unlocked the phone, so more phone calls etc etc.

Anyway to cut it short, after loads of calls and about 5 months since I bought the phone and 5 months being in contact with orange, they have today told me the phone is stolen.

What i cannot understand is how does it take 5 months to work out an iphone is stolen? I cannot get in contact with the person anymore, which doesnt surprise me after 5 months. But why take so long to tell me its stolen, theyve been sooooo dam slow.

Is there anything I can do as this all just doesnt make sense to me. Nobody would take 5 months to report a stolen phone, I find it unbelieveable that orange take 5 months to tell me its stolen?

If orange had told me this straight away when I registered the phone I'd of had a better chance of getting my money back.

I feel soooooooooooo peeeved.

Can anyone advise me, or help in anyway?

You then get arrested for insurance fraud. Have to pay the money back. Get refused for further insurance, Pay fine or go to jail.

    Good advice! :w00t:

i wish those that did it would get caught, but it seems like a good profit vs risk, and the ops phone was bought from such a person

Iphone will still work abroad, you still have the registration code for the phone when you changed tarriffs/user?

So you can sell it as a blocked phone abroad as "Fully working" for parts.
You'll get a couple of hundred for it.......

Or phone me on have a cunning plan....(ask for Des) reasonable hours please..(not after 8pm cheers)

PM the number to you...ooops ( originally put on here)

It might be worth calling Orange and explaining what's happened, tell them it looks like insurance fraud, there are way to tell what's been going on .

    eg:

i have phone from new, have the reciept and insurance for it.

    sell phone to you

5 months later latest phone comes out so i then report the phone stolen (IMEI is printed on the reciept), then phone network provider, then phone insurance company.

Insurance pay out so i get double the amount of money and you get a blocked phone..

    sorted.

I think ive just put a spanner in the works for that to happen :p

Ive just got off the phone with orange. Sorry it wasnt 5 months since I got the phone I made a messtake. I registered the phone on the 1st March so its nearly 4 months. The woman I spoke to was trying to get through to the fraud department but they are closed, she gave me a womans name who will ring me tomorrow from that dept. She said she couldnt tell me when the phone was reported but let slip it was the 23rd, I dont know why she couldnt tell me?

So I will have to wait till tomorrow now to see what this woman says, it does seem as though ive now set off some alarm bells with orange due to me having the phone so long. Hopefully the little bliter will get whats coming to them now. Whats also helped in my favour is that I registered the phone as soon as I got it. The original owner will need a veryyyyy good story to explain why they havent reported it sooner, and why Ive had it so long.

There is no way im giving up this phone without a fight.

You do still have the name/address of the person you swapped with ?

    Dude,

A crime as been committed. It has been falsely reported as stolen and is your properly.

Send your emails of conversations with user, any logs of conversations to orange. An exchange of items took place? you said swap site... I'm sure you sent something to them too in exchange? money ... another item?

If you had recorded delivery of the phone (which i'm guessing you did) then you have proof of delivery (well .. proof that something was delivered).

Get details of that to orange too.

    Something doesn't add up here.

The phone isn't blocked right? Have we definately 100% assertained we aren't dealing with a mentally-challenged customer service rep?

It has been known to happen....

When trying to unlock my original o2 iphone i had all sorts of random excuses thrown at me, nothing quite as heartstopping as in this thread, but not that far away either. Never underestimate the stupidity of the people who work in call centres.

Sorry for my earlier comment misread, makes you sick there are people about like this, you have their address they deserve what ever you decide to do(wink)

Go here and check if its reported stolen

    http://www.checkmend.com/uk/

Costs £2 but its worth knowing if you've got a stolen phone in your hands...

And did you not use the iphone for those 5 months?

The phone is now blocked, but its only just happened in the last few days though. It has been working perfectly since the day I bought it. This is what doesnt make sense. Its either a case of the person has only just reported it stolen, or orange have taken nearly 4 months to block the phone.

And im not sure about the mentally challeneged cust rep lol

I havent got the details of the person I bought it off anymore. I closed my account down on the swap website I went through thinking I didnt need it anymore. Stupid I know but its my own fault.

Ill just have to wait and see what happens when I speak to the fraud dept at orange.

Meh, fair play then, sounds official.

I suspect you won't get anything from orange. Its worth keeping as a ipod touch with gps though?

Try asking for the account to be reopened, I'm sure it's possible unless there's another reason for the closure.

What's the name of the site involved ?

On the very early versions of the iphone's it was possible to change the IMEI number, not sure about these ones though. At the end of the day, if you end up out of pocket considerably, i would do that myself. Illegal or not.

Just had a look, and it isn't possible anyway. Hopefully Orange will sort the mess out. I always thought though, that network's cannot unban IMEI's...

The network that blacklisted the handset can lift it. It then gets lifted across all networks after a few days.

Once the op talks to the fraud dept and explains what's been going on they can check 'things' and see he's on the level. Not sure what they'll do, but I think he'd get a result (I know what I'd do)...

Sorry for not getting back sooner.

I spoke to orange who clearly dont know what there doing, the bunch of idiots.

They said the phone was reported stolen on the 17th of march, but due to a computer clitch the system didnt bar the phone untill this week. They apologised and said there was nothing they could do. They did say that they had blocked the original owners new phone as they had clearly sold it, but wether that is true or not I dont know. I got the feeling they said that to try and make me feel better.

So im now stuck with a useless phone mostly thanks to orange.

Thanx to everyone for their comments and suggestions, ill just have to wait and see if anything can be done in the future.
    pinkleponkle
Surely it's mostly down to you buying off ebay and not direct?
    aScottishBloke
That's pretty unlucky for you, however thanks to Orange you've had a good few months usage, whereas you might have had none before.

Have you asked for your old account to be opened or attempted to get back in touch with the other swapper ?
