I need help with ebay

I won an auction on ebay last week for a kids Jcb power washer.The seller had 100% feed back and described the item as BNIB.Postage-Royal mail £4.99.She said she had just taken it out of the box to make sure all the parts were there.I happily put on a bid and won the item.Now I haven't paid her for the item yet I was to do this tomorrow,but an hour ago I got a knock on the door from DHL asking me to sign for a package.I did so and was surprised to find it was the power washer.Handwritten on the front of the package was handwritten "Postage £17.66".I opened the box and the power washer is not new.It is filthy and it is scuffed everywhere.And on top of this, the part where you attach your garden hose is broken..It was just lying in the bottom of the box.I am fuming.It was to be a christmas present for my little boyNow being a novice at ebay,I don't know what to do.I want to send it back to her tomorrow signed delivery but I think she should pay for this.I don't see why I should be out of pocket.What should I do now?Thanks for any help.

contact ebay and file a dispute on paypal item not as described take some pictures etc as evidence

I haven't paid for it yet I was to do it tomorrow and she said that was ok.

how would he file a dispute with paypal when it hasn't been paid for?

OP I would email them and say its not as described and ask her to arrange collection
You haven't paid yet so nothing they can do!

edit: colinsunderland makes a good point.. you have to actually pay for the item before you can open a dispute!
If i were you, i'd just send a polite email to the seller saying the item wasn't as described and that tey should arrange for a courier to come and collect it.
You're lucky you didn't pay for it and then have it turn up all filthy.. would be much more a headache resolving the situation if that were the case...

Yes.She said she would send it 1-3 business days after payment was received.I don't understand.

Well if you have not paid then I don't think you can open a dispute. Contact the seller and say you are not happy and ask her to arrange collection of the item.

She can't make you pay for the item nor the delivery.

if she wont pay for collection, stick it in the nearest skip. dont pay to send it back

Yeah it is.It's the only thing my little boy wants for christmas and I couldn't get one anywhere.Then I mentioned this on a thread on here one night last week and another member kindly pointed out the ebay listings.

Thanks for all the help guys.I have emailed the seller through ebay and asked her to arrange collection and told her why(like she needed to know!).I will see what happens next.Rep on it's way to you all.

Yep,that was me,although i never got a reply from you so i thought you hadn't got the PM.

The seller seems to sell a lot of items,perhaps they are catalogue returns,but BNIB it certainly isn't by your description of it.

I just checked my ebay this morning and she has replied by saying,"Thats fine although we have not had the payment confirmed from you so this needs to be sorted out asap."

OMG!!!!!!!! Ok be firm but polite explain that you have no interest in the goods as they are not as described, it's pointless for you to pay for it only for ther to have to refund you instantly, it's really her look out that she sent it before payment.

As you do not wish to keep the goods you will be returning the item at ther cost ot collection at a mutually convineint time.

I expect you will get a npb dispute opened but tbh, you can get that sorted out especially as you are willing to return the item as if you had of payed it would be a snad.

was the handwritten message of postage costs written on an official dhl form or just written on the box, if it's just written on the box i would not believe this as being the correct cost.

stick the box and its contents on the bathroom scales and double check the delivery costs with dhl.

Ok so I got in contact with her and this is what I received on 9 dec,"Hi there, this item cost £21.99 to post to you and it will be the same cost for me to arrange a return. you have not paid for the item so I think its best that you keep hold of it and I will get ebay to cancel the transaction."

But it still shows on my ebay that I need to pay for this item.What should I do now?

P.S she left me good feedback saying come back soon!

dont pay, and make sure you keep all the emails..

something similar happened to me, I forgot about it as the weeks went by, then signed to my account one day to find the seller had opened a non-paying bidder dispute. I replied, copied emails etc, but still ended up with a strike at the end of it! I tried to dispute it with Ebay but I didnt have the copies of the emails from my inbox (who would, with the length of time that had passed), I only had the messages in my Ebay, Ebay informed me those were useless. In the end I gave up.. just one in a long line of annoyances from Ebay!
