I Spit on Your Grave DVD removed by eBay - update reply from eBay by email.

Just gone on eBay today to find an alert.
I listed last night a dvd called I Spit on your Grave, they gone removed it.
Stupid thing is,you know when you sell a dvd or a cd and you search title and it gives you a selection to give info on to save you filling in details about your item, well this actual dvd is in their inventory.
The EAN number on barcode at back of case matches up exactly.
Why remove something on auction that they put in their find your item section that they list in their inventory.

This was one of the infamous video nasties of the seventies and eighties and was banned for years but was given a certficate for release in 2001. It was originaly called Day of the Women and only re-titled I Spit on your Grave when it was re-released in 1980. It also had titles "The Rape and Revengeof Jennifer Hill" and "I Hate your Guts" It is still banned in many countries including Ireland. I don't understand why E-Bay should choose to remove it as even Amazon sell it, perhaps you stated you would post to Ireland where it is still banned?.

I've just been on phone to eBay,they can't answer my question.
I asked why is it when you go to sell this dvd I have,I can search title and there is 3 choices of prefilled information in your inventory and I can select one that matches my dvd exactly including the EAN number on the back of the case.
I said you having that on your inventory gives the go ahead that this dvd is acceptable to for sale on there.
They useless anyway on customer services,he said we just going round in circles here,I said no I only got 1 question why removed if it is in your inventory, then it should be acceptable to sell on there.

I do worldwide shipping on everything unless the item is too heavy.

The interesting thing is if you search for it there's quite a few available from the US :?

Also if you search for 'spit grave' you may find it throws up a film called I spit on your corpse, I **** on your grave which oddly enough I can't find at all on the BBFC website. Quite possibly because they refused it a classification...? So that 'should' discount the 'it's banned in Ireland' argument I would have thought.

If Ebay remove an item they usualy tell you why they have removed it, what did they say in the message telling you it was removed?

We appreciate that you chose eBay to list the following auction-style listing(s):

260228499965 - I Spit On Your Grave - Meir Zarchi Film

However, your auction-style listing(s) breaches eBay's Adult Material policy and has been removed. In accordance with our User Agreement, items prohibited by law or by eBay policy are not allowed on eBay. We notified members who placed bids on the item that the listing has been canceled.

You're not allowed to list erotica or sexually oriented materials on eBay.

"Adult" or "sexually-oriented" material includes, but is not limited to:

- Any visual representation of human genitals presented in such a manner as to suggest sexual activity
- Any visual representation of any form of sexual intercourse
- Any materials clearly designed to sexually arouse the viewer/reader
- Any items which, because of their nature or because of the item description, appear to be designed for use in sexual/adult activity
- Any items which depict human sexual characteristics in a degrading fashion
- Any item that portrays frontal nudity will normally be treated as "adult" material
- Any images of nude children, including any vintage images. Recognising that images of nude children often raise legal concerns, eBay has made a policy decision that it will not permit them to be listed. Such listings, even if described as nude "teens", "children", "youngsters" or "nudist" are not permitted
- Any items depicting bestiality, rape sex, incest, sadism, masochism or sex with graphic violence or degradation
- Any items which suggest the availability of any form of prostitution or sexual relationship, including "virtual" boyfriends or girlfriends.

In considering whether to end such reported items, we consider the overall content of the listing, including pictures and text. For example, if an item description leads us to believe the content of the listing or the item is adult in nature, we will end that item. Blocking the "risqué" parts of an image does not exempt the item from these standards.

For more information on Adult Material please copy this link into a new browser window:

that is most of the message that they sent me,the point is here its in their inventory. If you go to sell and put in the title of the dvd,you cna tick you want it in the dvd catergory, then on next page it gives you a selection of dvds and the title I have here is exact one in their inventory by EAN number.
The dvd is for sale by Amazon and probably a lot more other websites that you don't tend to get adult material from.

The BBFC has placed this work in the HORROR genre(s).
The main spoken language in this work is English.

It is:thinking:

Although I admit, from the title it would appear to be more a zombie type film.

We should all know by now, EBAY MAKE THE RULES UP AS THEY GO ALONG !!
They get first place for the most unfairest company on the entire planet. I had something taken off once that they were actually advertising at the bottom of the same search results page !!

Yeh they do just that. I told them on phone no wonder so many people are getting fed up of eBay.They haven't got any answers for anything.
I'll just go sell the dvd on Amazon.

I had an auction cancelled because I used the words 'AS NEW' in the title. Apparently I was trying to catch people searching for new items by using that phrase. I searched for 'as new' and got over 1000 listings I tried to report all of these but ebay said I had to report them 1 by 1.

It basically comes down to whether you are reported, ebay don't go looking for these things.

Not sure why this dvd would be in the inventory, unless the inventory isn't directly related to whats permitted on ebay ie. If I put in the bar code for big hooters 4, it may come up regardless.

I may be wrong but is this just a case of another ebayer reporting your auction and ebay removing it without checking ??
I seem to remember similar ?

I think also the worldwide posting could be an issue but not sure as it's hard to find the correct info.

Hello,

Thank you for writing to eBay. My name is Brock and I appreciate the
time you have taken to write to us.

I have reviewed the listing in question and have determined that it was
removed correctly according to our site policy.

Although "I Spit On Your Grave" is not an adult video, it does contain
some very strong mature content. We realize that it is legal in the UK
to sell this item, but eBay has chosen to end this film on the grounds
of the demeaning nature of the movie as it contains violent sex scenes
and inappropriate content.

I can understand why you assumed that these items were allowed, since
their information was found in eBay’s pre-filled information database.
However, please know in the future that eBay’s pre-filled feature is
simply linked to a database containing information on virtually any
movie or book. This database has not been filtered or reviewed for
items that violate eBay policies. Therefore, while the pre-filled
feature does make it easier to list certain items, sellers are still
ultimately responsible for determining whether or not their item is
allowed on the site. I apologize for any confusion the pre-filled
feature may have caused. As a courtesy, I have removed this violation
record from your account; however, since the item itself is not allowed
to be sold on the site, I cannot restart the listing for you and I would
appreciate your co-operation in not listing this item on the site in the
future.

this my reply from customer services,I've not contacted them in ages about anything but pretty quick to get reply same day. This is their reply, they did say more but it was more about whatever policies they got in place.

Its misleading anyway to have it in the inventory. They say they removed the violation from account too.But any warnings doesn't affect us anyway as they still let you repeatdely list as I've been pulled up a few times about minor stuff so as plenty others I know.
Damn all this to sell an item for 99p or so.

yeh that As New rule is stupid, for yrs people have sold things ' as new' when putting in ads in local newspapers, supermarkets, newsagents and so on,its just another way of saying vgc.

Ask them why international sellers are allowed to list the item and it is visible to UK buyers then. One rule for the the good old GB and nothing for anyone else, just like been in Europe really.

I had a copy of this dvd removed from Ebay last year.
When I queried it, I actually got a human reply (rather than a typical automated one) !

It stated that the dvd cover (depicting a bruised woman walking away from the camera in a ripped skirt/dress and knickers) was the reason. No mention of the film content itself.

Go figure....

Yeh but I don't have much luck on here :? I've only ever sold 2 items and tried a few times. I not likely to rip any1 off either lol.

Ebays rules state any item depicting rape is not alowed, this dvd features the subject, so it was right to be banned. But not sure why it shows up on their database.

If thats the case why arn't they removing others like The Accused then or The Last house on the Left maybe Clockwork Orange,Death Wish,Deliverence etc etc.Not forgetting Irreversible which has a nine minute rape scene. EBAY rules mean nothing ,they'll just remove what they want when they want. They are only interested on the FVFs Not too keen to get rid of the pirate stuff though.

The Last House on the Left is quite similar to this Spit on Grave one.
There loads of films with rape scenes.

I have had a listing removed for breaking copyright law (apparently)
I listed virtually all of my VHS videos on there a while ago and one didn't have the paper sleeve so i mentioned that in the listing, it was removed under their copyright rules as though it were a fake. I never questioned but I guess eBay are really trying to be better safe than sorry

Ebay only act on things that are reported, they can't look at every auction to see if it is suitable so they rely on users reporting unsuitable listings.

Ebay is a bit of a bias mess.

There's a seller who sells pirate software, I have reported him no less than 3 times and his auctions are never removed.

There was another occassion when I was selling a dvd which was removed as it was not region 2 and there was another powerseller selling the same item. I believe he got my item closed, I reported his item but ebay never took any action against him. Ebay double standards, never upset the powersellers...
#30
I tried selling my old Sky card the other week as there are quite a few sold on there and they go for anything up to £30 (I've got 2 doing nothing) so I listed one and it was removed within an hour!! Still others selling them. Wasn't best pleased, but then thats Ebay for you!
