I payed for an item on 23rd octobe and it was sent on the 24th and im still yet to recieve it and i just want my money back to get the game my self, so i messaged them and claimed with paypal and this is the message they sent me.

Dear odriscoll,

Just to let you now, we are raising a claim with Royal Mail, this will take a while, will be putting in on wednesday with proof of posting, if and when we receive this, this is when we are willng to refnd you if you have still not received the item, can you let us know if you receive in the meantime and we will do the same, as you haven't waited the 15 days which was on wed 14th and then still can come back to us, best regards georgina

Surely been 15 days now and i thought they were meant to give a refund and then claim back off the royal mail.

No first class they told me.

You can return it under the distance selling regs.

You will have to purchase it elsewhere in the meantime, if you want it in the intervening time.

then to be honest i think ts only fair that you have to wait, this is the problem sending unrecorded, nobody actually really knows where the item is, i am still getting items sent the beginning of october

Thats not applicable if its a private sale. He hasn't said what the item was and from whom to know that.

But if they can prove the item has been sent (which they say they have the reciept of postage) then there is little that can be done but wait.

What was the method of payment?

Its not gone past the 14th November yet, so they are still waiting for the Royal Mail to get back to them probably.

Think your'll need to hang tight for a few days. No doubt you will just receive your money back and they'll get the "full" insurance value and not just what you paid (if the value adds up to be able to do so!)

Where did you buy your item from if you don't mind me asking?

I had a paypal claim taken against me for a phone I sent and although I had proof of postage because I couldn't prove the buyer had received it paypal honoured the claim in the buyers favour and I had to refund over £400 for an N95 when they just came out.

The moral of the story, Special Delivery saves this hassel! :P

I assume you mean you've opened a dispute on paypal, you should be able to close the dispute and get all your money back as they can't prove you've received it.

No it was going international, long story, misselling from post office resulted in it being sent airsure instead of the other international option, airsure only tracks it to the country not to the specific recipient, god only knows why that service would be of use, but we were advised that we could track it and prove it was signed for with this.

Anyway the long and short of it is, paypal sided with the buyer because although we had proof of postage we couldn't prove they had received it!

I'm no expert on these matters so check with an expert before you do it but I'm pretty sure you can choose to end the dispute (or let it run to the end naturally) and because they won't be able to prove they delivered then you'll get your money back (I THINK!!!)

AND

Although I had taken insurance on the phone they failed to check wehter it was a phone or not and if it was to tell me that the max you can get back for compensation for a phone if £38 and what u paid for postage, so I got about £54 back!

Thats awful! Though if Im honest, I'd never send anything of that value overseas - let alone without proper cover.

I know, but we had listed it 3 times before and been done over by Nigerian scammers, hence why we double checked with the post office and took insurance! Lol

unfortunately the compensation for international signed for mail only covers up to £34 for mobile phones as well.
