Iphone help

My friend has an iphone 3gs which has warrenty till feb '12
The problem is the case has split at the top, no apparent reason why, he kept pushing it back in and it would come undone again etc then one day the clip broke so it will no longer close the gap. He lived with it anyway 1 month later he took the sim card out and now the sim card tray wont go in properly, it goes in bar a few mm so the sim isnt recognised

My question is will apple fix/replace it, im only wondering because of the split they may think he dropped it thats why the tray wont go in.
Hes going to send it to me so I can go to the apple shop as there isnt one near him but thought id ask to save the expense if there just going to say he dropped it
