Am I right in thinking when you claim for an iPhone they always send you are refurbed phone or does it depend on the insurer, I always thought everyone sends out Brand New Refurbed.

Worth checking your policy to see if it basically says 'new for old' - I would then assume that wording to this effect would be that you get a brand new phone.

I have a problem now, as I have sold a phone on here assuming all replacements are refurbed, the buyer has now msg me weeks later saying there is a problem with the phone, she has taken it to Apple and they have said they wont fix it as it is made up of parts of different phones, which what refurb is, where do I stand here.

Yes, I had it sent from insurers, I turned it on to check if it was working and all was fine.

They are trying to say the description I put was wrong tho, as I put Brand New replacement from insurers, does this matter?

If you did not know it was a refurbished unit, then I cannot see it as much of an issue.

Perhaps contact your insurers and see if they will repair the phone you sold on.

Surely a comment like this should have been done by PM....Not a lawyer or anything but this does not sound quite legal...:)

What doesn't sound legal, I lost my phone so
I claimed for it, but in the mean time bought a iPhone 4 so when I had the replacement sent I sold it, where is the crime in that?

Mate what I meant sounded illegal was getting the phone that you SOLD repaired by YOUR insurance Company and making out as if it still owned by you....Don't care whether you did that or not, all I was suggesting is that a comment like that really should have been made by PM or something.

But then surely you would have put the new phone on to your insurance ? rather than the replacement for the old one ? unless you are one of the lucky ones to have insurance for 2 phones, mine is only 1, so when I broke mine, they fixed it, but by this time I had bought the new iPhone4, so I passed it on to my daughter. Her's is still insured, because she's more likely to break or lose it than me...................I hope !!!! Says me who dropped her 3gs in the sea oO

This is why I didnt sell mine, whole new can of worms to play with when it comes to breaking/blocking etc etc.

Hope you can figure it out.

Plus, you have to be the owner of the phone I would have thought or the insurance wont do it, not that it would take much to prove you still were, even though you are not, but they wouldn't be able to send it out to someone with a different name/contact details maybe......dunno.
