Jammylad sold me a STOLEN phone- advice required please!

I bought a phone from Jammylad on 17th January (see thread WANTED: Mobile handset on 3 network....must be cheap!)

When the phone arrived, it said USIM inactive on the screen. 3 told me it was blacklisted. Jammylad pleaded innocence saying it was his dads that he didnt need anymore then accused ME of tampering wiht it an breaking it.

I have now had it confirmed by another board user who has contacted vodafone that the phone was reported stolen!

Its a Sony Ericsson k610i and the IEMI no is *REMOVED*.

I have the name and bank account no where the money was transferred to. I do not expect my money back but any advice on what to do next would be appreciated.

simple, call the police.

edit - should probably report this directly to the admins too so they can put a block on him selling anything else through the site until his innocence can be proven.

The mods already know? Hence sigmas comment on the bottom of the thread in question. If you trade totally off the boards, with no offer or acceptance made and no exchange of contact details, its hard to see what the mods can really do - its your word against his (don't get me wrong, it certainly sounds like you've been had and the seller knows what they are doing but because of the way the trade has been carried out its a private matter). Contact the police :)

Edit - Actually, from the feedback they have given you it seems they are admitting they sold the phone. I guess if you can prove the phone was reported stolen before it was sold then you certainly have a good case and they should be banned...

Some points for clarity....

1) I'm the other board member. I don't work in the trade though - any of you can ring up your operator and ask them to check the IMEI. As (hopefully) a trusted user, I asked for the IMEI number, rung vodafone myself and they confirmed that 1) it is blocked and 2) it is marked as stolen. I haven't spoken to Jammylad - just helped cabbage out best I could.

2) Yes, he dealt by PM. He knows he was an idiot, I know he was an idiot, and everyone else knows it to. The fact is, he's been ripped off.

Even if you think "well he sold by PM, sod him" - THINK - regardless of how it happened, the feedback confirms that the sale DID take place. Now, Jammylad DID sell the stolen phone, so whether you think 'cabbage' is a fool or not, its in EVERYONES interests to keep people like 'Jammylad' off the for sale board.

Just some info before you all jump on him about dealing via PM.

As for what to do: My advice would be goto the police - and especially if you have his name and bank details. He's selling stolen property regardless whether he actually stole it.

As for HUKDs... personally I will remember never to deal with the grub known as 'Jammylad' - however, really I think the mods should be using some common sense here and banning him - at least from the for sale board.

Edit: BTW, according to vodafone, it is impossible to "mess around" with a phone and have it locked. There is a set process instigated from the network.

No, I did enquire but was told it wasn't available/wasn't allowed to be told.

However, as I say, you can't get your phone listed as stolen without reporting it as just that. So regardless of the date, he's still been ripped off by my reckoning?

Not disagreeing, just a date would have been proof that what the seller is saying (ie buyer bought then got phone blacklisted themselves) is not true...

PS Its jammylad, just incase anyone called jimmylad exists and is getting unfairly tarred!

agreed...he messed up but its done now cant be changed and I think this will obvo teach them not to do it again so its now down to how we can help this guy

Oh no - I wasn't trying to argue, I just genuinely don't see that it affects the outcome, other than being an ultimate proof.

Liek I said, you can only block it by reporting it as stolen, so unless the buyer did that (which would be incredibly pointless), It must have been either the seller, or the original owner of the phone.

I'll go back and edit my posts about jammylad btw - thanks for noticing! :)

The problem you see (and I'm sure it hasn't happen here but it could in the future) is the reverse scam: Someone lists a phone for sale, someone else has same model phone already which is either broken or stolen. They trade via PM, buyer claims seller has sold them a stolen phone and claims money back and keeps bonafide phone... Selling 2nd-hand phones is inherently risky anyway (always make note of the IMEI - you're probably okay if the phone was originally yours and on contract but otherwise it might be hard to prove ownership).

I think in this case the buyer will really should go to the police with all the details they have, which hopefully will result in at very least the seller getting a severe warning (and if necessary claim the money back through SCC). Its a pity this site got rid of the 'traders to avoid' list but it did and its not coming back so its down to people to read the sellers feedback and make their own minds up...

If thats true that its more evidence to give to the police and/or courts as applicable. I guess the stumbling block will be lack of address (although the police can no doubt get that from bank details - whether they can pass it on is a different matter). I would also hope that if that is true, the buyer should pass those PMs on to admin/mods who would then ban the seller (knowingly trading stolen property must be a permaban offense whether done through the correct procedures or otherwise!)

For those flaming me for buying via PM I didn't know this was not the way to go. I've never bought or sold on the board and I'd just posted looking for a phone. I am not expeting the £ back and the main reason I'm feed backing is to warn others. I doubt if Jammylad had sold it on the thread it would have made any difference as me or some other person would still have got shafted.

You can probably get the money back, but you'll have to take some steps. First you need to contact the police (it is after all a crime to sell stolen goods), then from there you may need to take it to court (although he may refund well before to stop that happening). Even if you had followed all the procedures, this is still the approach you would have to take if he's refusing to refund you, but by all accounts it is something you should do if you can... :thumbsup:

OK cops it is. As I said I'm not that bothered about the £18 and have been taught a harsh lesson, but I donl;t want the little thief to get away with it!

i wasn't flaming you at all hun ;-) just stating the facts as far as i could see as to help you get your money back.:thumbsup: i hope you've kept all the pm's he sent you & the police can help with getting your money back & maybe charging jammylad with selling stolen goods!! people like him make it so difficult for either new users or people who are new to the for sale boards to know if they can trust the buyer/seller :-(

No one knows the phone was stolen, so HUKD are unlikely to ban someone because unconnected parties without a clue are saying so.

I am sure if you phone/write to the seller, it can be resolved before it gets long and contracted.

I think your living in another world if you think that a letter or a call will resolve this seeing how the OP has already had PM's affectively telling him to push off

Before you make yourself look even more of an idiot - read the original post, phone your operator and ask them yourself if you are that way inclined. It is on the UK block list, and all operators will happily tell you the same thing.

I realise you love being a complete ********, and I realise you love the reaction you get. But why? I dealt with you recently on the FS board, and you were great to deal with and I was very pleased. So why are you such a complete **** on the forums? Why? I really don't get it.

Cabbage, I think if you contact the police, they should take the phone of you however if they are unable to locate the owner or its not claimed by them then you can get it unblocked by the network, you will however need proof from the Police though that you now legally own the handset...

Hope you get it sorted mate, dodgy shops should be able to unblock it for you, however thats illegal and will also end up costing you more... It doesnt really make any difference if you bought it here on the forums, through PM's or even ebay, you bought an item from a seller which turned out to be stolen, provide the police with the sellers full details...

Also in the OP's defence, On my first post asking if anyone had wii play, I received a PM from someone telling me that they had a spare and would sell it to me. I too hadn't read the rules correctly, but then again, do you always read the small print/conditions of sale/T&C's. Anyway, I asked if they had an ebay account etc... which I checked but my gut insticts told me not to deal with this one so politely declined.
It's not until you get hooked to this site and read this sort of thing that you realise there are/have been a lot of scammers on here. I've truly been put off I'm afraid so only post deals or ask for advice.
Shame really as HUKD is sooooo cool. It's based on a whole lot of goodwill from kind people that share their good fortune or life experiences.
