Just bought a new car, legal help required.

Hi all,

iv just been to citroen and swapped my mini cooper 1.6 53 04 done 70k + £450 cash, for what i thought was a citroen c2 1.4 furio 56 07 done 17k. i got my weeks free insurance from citroen but when i came to insure the car yesterday with direct line i was made aware that the car theyve sold me is a 1.1 furio as apposed to the 1.4 furio that they had advertised to me and that i had signed for.

now iv been back to the garage and notified them of this and told them that i am not happy, theyve offered me 3 options, either reverse the deal, theyll give me £450 cash or they will find me a 1.4 furio (which i highly doubt they will manage or will want more money from me). does anyone know what my rights are in this circumstance and does anyone have any advice on what theyd do in this instance?

They have given you your options

1. Reverse the deal.
2. Find you a 1.4

If they find you a 1.4 tell them you are not paying any more for it.

What does the V5 say? Insurance company may have made a mistake

Hi thanks for your reply, the v5 says its a 1.1 its just that citroen had it down on there system as a 1.4 apparently and all there paperwork they made me sign stated that it was a 1.4.

So they boobed. If you really want a 1.4, make them find you one for the same price.

What I cant understand is why you traded a Mini for a Citroen.............

because theyve offered me £450 cashback and accept the car iv been sold but i think i should be offered more. i dont want the old car back because i wanted rid of it. and theyll want me to pay the difference between the new car that they find me. i was just wondering wether they should just find me the 1.4 version with the same miles and colour etc at no extra cost as its there mistake? and also where can i go from here if i cannot reach an agreement with them?

if on all the paper work it stated 1.4 and its a 1.1 the contract could be classified as voidable anyway due to its being vital, and/or not correct description.
But they seem like they are being fair, offering you to reverse the deal or find you the car they thought they were giving you.

agreed id fight it that if they honestly believed it was a 1.4 they were selling to you then they should find the 1.4 for you at no extra cost due to the fact that they were willing to give you a car that was the value of a 1.4 (as it was meant to be a 1.4).

the mini i traded had done 70k miles needed a new exhaused and door mechanism aswell as other bits and bobs was due an mot and was 7 years old..... and i wanted a newer car that was cheap to run (albeit not as cheap as a 1.1) that i could preety much straight swap the mini for.

I worked for Citroen for 2 years as a service advisor and all saxo furios and c2 furios were always 1.4.

I am miffed by this.

on Honest John it says: from February 2004 include 1.4i Furio with manual or Sensodrive gearboxed

to be fair its only really noticable when iv taken it on a roads, its supprising how nippy it is for a 1.1, the reason i want the 1.4 is because i dont want to have ran the thing into the ground in 12 months time.

You are missing the point

The deal you signed is for a 1.4 Furio, so they cant ask you for more money!

i thought that too thats why it never really crossed my mind to be honest but the v5 says its a 1.1 furio aswell as the hpi sheets etc.

Check your vin plate on the car as it should tell you the engine size:

i know yeh but i what do i do if he keeps telling me he cant find one? i really dont want to have to reverse the deal to be honest because i cant be doing with the hassle, and after looking in the cap book and speaking to people in the trade theyve told me i want at least £700 cash back if im to keep the car iv got.

lol thanks youve really made me feel better about the whole thing! to be fair i think theyve come a long way to be honest. and i thing there a decent cheap car.

The C2 1.4 Furio , VTR and Manual VTS are good fun for small cars, the manual GT is utterly mental.

i think im going to push for them to find me a 1.4, so am i right in thinking that theyll have to find me one thats the the same year, same mileage and condition as the one theyve sold me as a straight swap again? repped everyone thats replied to this thread thanks.

As I said, have a look at the vin plate and just double check the engine size just to confirm.

Yeah get a strait swap for 1.4 as the 1.1 is gutless, I'm amazed you didn't notice the difference, lol.

it may sound silly. but, could the ex owner of the car have had the engine replaced with a 1.4?

i have replaced an engine in the past to a higher spec model, which would not have been recorded by any insurance comapny

i know what your saying but to be honest now i know its a 1.1 i can tell its a 1.1 if that makes sense. the reason i didnt notice when i test drove it is simply because i just thought the c2 furios were all 1.4s.

strange why it was recorded as a 1.4 on citroens system tho! i used to work at a van sales garage and the first thing we did when a vehicle came in was enter the details on the system direct from the log book!

ok another tought, could the cars vin plate been taken off a 1.4 and put on a 1.1? or something dodgy like that?

Yes

anything else tell them to shove it

If they dont find you a 1.4 and you are happy with the 1.1 then ask them for the difference

u entered a contrat with them, they havent kept to the deal so u wont have to pay any exra, they are at fault not u. Go to C.A.B They will keep u right, but DO NOT HAND OVER ANY MORE MONEY!!!
