I had a flight over xmas to california and the outbound was delayed 4.5 hours so i filed a claim with Norwegian and they have agreed to pay me 600 euros!! what a result. Means i flew to the US and back for £27 after their refund! lol bargain!!
Glad i didnt use the ppi vulture lawyers either who take 25% of the cut!

My boyfriends Norwegian flight was delayed 7 hours but they didn't pay out :( said it was a problem that they weren't responsible for.

Unfortunately, fog is outside of the airline's operational control, so I would very much doubt it. There's also the rule that compensation on a non EU airline can only be claimed when departing an EU airport to fly to a non EU airport, not the other way around. Check for EU rule 261/2004 for more information.

no sorry you are not eligible because it is down to weather. Has to be out for circumstances out of control of the airline

BTW, I received £300 from Thomas Cook Airlines for an inbound flight from Tenerife. As sleepingwonder says... no need to use agents to claim back (unless the airline is being ridiculously stubborn about the airline's control rule).

There is another well known website (for us cheapskates! Nudge nudge - the other one) that has a tool that generates your claim, then sends it to the airline after you input your flight details. Worked like a charm and quickly got confirmation of a successful claim. :)

OP...what was reason for delay? I imagine they have a whole host of get out clauses

the plane was late coming back from its prior trip to NY, and apparently something bashed into the wing of the plane..Something like that if i remember rightly

After Thomas Cook fobbed us off for years we used Bott & Co and got 4 x 600 euros ( less their charges), as we were delayed 9 hours going out and 7 hours coming back. TC initially ignored us, then claimed 'technical problems' it was only after issuing court proceedings did they pay up. So, with court costs, they ended up paying over 3k. It wasn't a technical issue either flight, they didn't have a flying crew.

It wasn't a technical issue either flight, they didn't have a flying crew.

Surely you could have flown the plane yourself? :{;)

My compensation was due to our scheduled aircraft being used for an earlier delayed flight (I worked this out using various flight tracking sites). They put us on a chartered flight run by another company. They said the delay would be 2.5 hours but ended up being just over 3 hours hence the compensation claim.

Another piece of information if anyone cares....the delay is calculated against the scheduled arrival time and not the departure time.

The flight must have departed from an EU airport, operating by any airline, or it must be arriving into an EU airport and be operated by an EU airline. The 'EU airport' also includes the following countries; Iceland, Liechtenstein, Norway and Switzerland.

It also needs to have been at least three hours late arriving at your destination to be eligible for compensation and the ruling that outlines these rights is Regulation (EC) 261/2004

The amounts available start from €250 (£212) for flights of less than 1,500km long which are delayed by at least three hours and go up to €600 (£509) for flights of more than 3,500km between an EU and non-EU airport, delayed by at least four hours.

So you might have a claim if you departed from an EU airport on any airline or you arrived at an EU airport on an EU airline.
