Once you refunded the transaction and the buyer fill in the Mutual Agreement, you will have the Final Value Fees back from Ebay

the buyer is not going to pay for it i told her its damaged ???????

i can cancel the sale through my ebay , as a damaged item but will the fees come off

go to the sold item, on the right click the drop down arrow and click 'cancel transaction request' fill that in and if the buyer accepts you will be credited your fees back.
