I was just wondering if anyone received a copy when it was £15 at tesco online?

I've just checked my online banking and even though my order was cancelled they still took the money from my account then refunded it?

Anyone else experience this?

I got one, but missed out on cheap thortons chocolate, dirty harry for £2.99 and dj hero for £35 and then I missed out on cheap wine. One out of 5 ain't bad.

You are mis-informed. Most companys T&C state that the contract is only legally binding once they despatch the goods, and that until that time they reserver the right to cancel the order and refund the money.:thumbsup:

Tesco Direct T&C:

[COLOR="Red"]4. Payment and acceptance
If you buy an item from the Tesco Direct Catalogue on the phone, in-store or online you will be charged for an item at the time you place your order. After this time, you cannot amend your order (but please see our cancellation policy in section 6 below).

Your order is an offer to buy from us. Nothing that we do or say will amount to any acceptance of that offer until we actually despatch an item to you, at which point a contract will be made between us. At any point up until then we may decline to supply an item to you. If we decline to supply an item to you and you have already paid for it, we will give you a full refund of any amount already paid for that item in accordance with our refund policy in section 7 below.

Where items are despatched separately, our acceptance of the order in respect of each item takes place when that item is dispatched.[/COLOR]

They didn't actually get away with on that information. Midlandcomics fought for a bit agains't them and I believe it was some other silly comment in there T & C. Either way just ain't worth arguing with them.

You're right. I'm sure their lawyers are far more savvy in these things than any of us.

(I did get £45 from Laskys last christmas though in respect of the mis-priced microwave!!)

Yeh it's probably worth having a mild whine to get some vouchers or something.

My argument was that they actually sent an 'order despatched' email to me. They argued that it didn't matter until they actually had despatched, which they hadn't. I argued that the email made me rightly assume that the contract was thus made. Took it to small claims. Before the case they offered to pay me half of my claim on condition that i 'kept schtum'.
