Legal advice re: Swopex changing to Hitflip

The DVD/Game/Music swapping site Swopex.co.uk has now changed to Hitflip.co.uk.

Swopex allowed you to buy and sell stuff with no charge and withdraw your credit to your own account for a £1 charge. I used it a lot and had a credit of about £65.

Now it has changed to Hitflip, you have to buy Flips to make exchanges, and my credit has been increased by £25 as a welcome gesture I guess, but you cannot remove your money.

So this money that I made from selling my things, is no locked into my hitflip account, even though the site now says

"Also there will be no withdrawal fee - rather a 79p transaction charge per trade payable by the buyer (GBP 1.49 for items valued 4 flips and above)."

You cannot make a withdrawal.

Their technical support have told me

"Unfortunately it's no longer possible to withdraw your credits. Hitflip is a
place to barter your media items. Please take a look at the whole process at
http://www.hitflip.co.uk/howitworks.html [U http://www.hitflip.co.uk/howitworks.html . Thanks!"

I've now replied to them telling them I wish to close my account and for them to send me a cheque for the balance of my account.

Where do I stand?

Swopex customers weren't given any advance warning of the change, the site just changed overnight.

Surely it's unlawful to refuse to give someone their money back that they originally were allowed to withdraw.

Any advice and views are appreciated.

Can't really help that much as I think you may need to seek specialist advice. Maybe C.A.B. will be able to help you on the legal side.

An observation would be to be careful about instructing them to close your account. Have a good read of their Terms and Conditions situated here:

Whilst I understand your frustration at least at present you have salvaged something from the takeover. Can you not use the credits (flips) you have to claw back some sort of value from goods and then maybe sell those goods on ?
This would obviously be better than losing everything.

You will probably know Hitflip are a German company who appear to be expanding accross Europe. Interestingly down the bottom of most pages on the site and nearly invisible is this statement:

It looks like they are going to be creditting my paypal account with my balance after I complained. And threatened to take it further.

Support have been very helpful so far.

I don't have naything against hitflip, in fact i may give it a go, it was just my money being held to ransom that hacked me off.

As for agreeing to the terms and conditions, I agreed to swopexs T&Cs, which included being able to withdraw your money.

So fingers crossed I should have my money soon.

Well that's good news, I hope it goes well for you.
My fear was that if you asked them to close your account then they would do just that and you would lose everything !

As an aside do you know what the link is with Amazon.com ? :thinking: Be interested to know.

It didn't even need the threat in order for our support to give you support. We are more than happy to pay out the balance to any ex-swopex user who wishes for us to do so.
As you have pointed out our support paid to the outstanding credits to your paypal account with out any further issues arising.
We are looking forward to you giving hitflip a try ;-)

@hottoshop: link to amazon: listing your products on hitflip is really easy. All you need to do is enter your barcode which is on the back of your book, dvd, audio cd or game and we fill out the rest for you by parsing the content from amazon&co.
