Legal to use your mob while cars engine is running??

Hi a min ago I pulled over and stopped to answer my mobile, as I done this a police car drove past me and into the direction i was heading ,if he was going to fine me would he of done that there and then??maybe he just didn't see me??

It's generally taken to mean, the keys NOT in the ignition.

IF you know its illegal to use your phone in the car, why take the risk anyway?

It is a specific offence to use a hand-held phone when driving. A hand-held device is something that “is or must be held at some point during the course of making or receiving a call or performing any other interactive communication function.” A motorist can regard driving as meaning a vehicle with the engine running. In simple terms you can use a mobile as long as you don’t hold the phone and you can’t use a hand-held phone if the engine is running.

But if he wants to be a total **** you cant win. You leave the engine on and you get a ticket or turn it off and he gives you a ticket for obstruction of the highway!

I never get these handsfree ones cos you've got to use your hands at some point haven't you?

Provided you are not causing an obstruction, parked illegally or parking contrary to parking restrictions on that road. Then you won't get done by a copper for sitting in your car with your keys out of the ignition and talking on your phone, no matter what the copper is like. (besides I'd be surprised if most coppers knew the parking laws these days)

I always take the keys out of the ignition when I use my phone and am parked up on the road. However I make sure I am legally entitled to be parked up on that part of the road.

It's a horribly grey area, there have been instances of over zealous coppers booking people who are parked with their engines running. However, if they we going to do something, they would have done it there and then, so you are OK.

For about the cost of two tickets (£120) you can get a Nokia in car hands free kit, with a microphone and linked to the speakers.

No, with some bluetooth phones you can set it to auto answer to your bluetooth headset when a call comes in... and even without that turned on it's usually only pressing a button on the bluetooth headset... so no different than scratching your ear.

Well technically parking on any public highway is an offense. The worst offenders for this is councils who put parking bays and then charge you to park illegally!

Wow, I never knew you could get booked for being on the phone with the car engine running. I often see people pull over to the side of the road to take a call (have done it myself), I thought you just had to be stationary to be ok.

I think that they rather you were stopped the driving and on the phone..IMO I hate it when LORRY drivers are on there phones...they should be sacked!
