Dear HMV Customer
We write to you regarding your recent order for the following item:
TV DRAMA: NAVEEN ANDREWS: EMILIE DE RAVIN: MATTHEW FOX
LOST: COMPLETE SEASON 2: 7DVD: BOX SET
Unfortunately the item appeared on our website with the incorrect price of
Â£17.99, instead of Â£34.99.
We would like to clarify the position regarding this error, both from a
contractual position and with our proposals for how to rectify this.
The terms and conditions governing our online sales state that your order
is only accepted, and a contract between us formed, when HMV receive
payment for the goods you have ordered. HMV have not yet taken payment for
the goods listed above, nor taken the final step of confirming your
shipment order to you by email (please see point b. in the section entitled
"The Contract Between Us" on the first page of our Terms and Conditions).
When payment is to be made with E-Vouchers, the E-voucher will be removed
from your wallet on placing your order but will not be accepted as payment
until the goods are despatched to you. If the order is cancelled or not
fulfilled the E-Voucher will be re-credited to your wallet.
We are therefore under no legal obligation to sell the item to you at the
incorrect price and have therefore cancelled your order.
We would like to stress that this is a very unusual circumstance at HMV and
we apologise for any inconvenience caused.
