maternity pay

hi has anyone had to claim maternity allowence through the job centre, if so how long does it take to process. i was meant to get my first months maternity pay on monday from my employer but i have recieved a letter in the post today saying they are not paying it and i have to claim from job centre, which means im a months money down now till its sorted, why they have only just told me now i have no idea.

i returned from my last maternity leave in april this year and i was pregnant when i returned, i cut my hours down to 30 but i had a few weeks off sick due to suffering with really bad headaches and spd. i handed in my matb1 form ages ago to my work, i just wished they would of told me sooner they wont pay it.

I'd just print it and get it filled in today and take it on monday.

eh, so you only went back to work cos you were pregnant again hoping for more maternity pay? Thats shameful.

i didnt go back just for the maternity pay, i went back as there was no point in leaving to go to another job when i wouldnt be there long before i went on maternity leave, so it seemed the easiest option rather than messing about, plus i have been employed with the company for 7years, the reason they cant pay me it this time is i didnt earn enough due to cutting my hours and time off sick.

they are probably annoyed at you for being pregnant all the time, don't blame them to be honest

its people like you what **** me off, i didnt ask for your opinion on me being pregnant, so if you have nothing nice to say then dont comment, i wasnt milking the company i was entitled to maternity leave like any other pregnant women out there, i take it you havent got kids if your so against people having maternity leave and paternity leave. at least i work and dont claim benifits to look after my child i have worked since being 16 and never been a dole dosser like some mothers who cant even be botherd to work a day in their lives.

when am i supposed to have children then, when my employer says so, its my choice when i want to have a child and i am at a respectable age have a partner and bought a house and i am not some 14/15 year old sleeping around and doesnt know who the dad is.

hi thanks for not judging me, the reason they are saying they cant pay me is beacause i havent earnt enough, i will ring somewhere on monday and find out where i stand, i am more annoyed at them leaving it 2days before im due to get my monthly wage to tell me as now i am a months pay down till it gets sorted.

Yes she has, she HAS been employed by the same employer for 26 weeks, the fact she was on maternity is neither herre nor there, she was under their employment.

Worked which is the word you used and employed which is the word used as criterea are two different meanings entirely.

Like I say op I know someone in your position and the employer had to pay.

Op do speak to the job centre as it all depends on salary etc, etc, but they couldn't refuse you because you have been on mat pay I know that, so yes see what the thresholds are etc.

Fair enough then. Although one wonders how small businesses manage to survive if they have to continually pay out in circumstances like this

Yes I have a daughter thanks and took just the day of her birth off, it's not the fact that you took maternity leave it's more the fact you went back afterwards already pregnant again when really you should have just resigned. Nothing wrong with having children, but you shouldnt expect your employer to foot the bill so quickly after they have already covered you previously.

Best thing to do is speak to citizens advice or the job center directly to see where you stand cos it should have been obvious that your actions would rub people up the wrong way on here.

Read that, it's really good. I had MA for my first as I was already pregnant when they took me on (I was very clear about that at the time) then SMP for my second, then MA for my third as I, like you, didn't meet the earnings rule for SMP having had too much time off sick in the specific qualifying period. You will definitely qualify for MA, and as long as you complete the form accurately it'll come through very quickly. Don't worry about what other people say - you're entitled to what you get so get it.

In fact IIRC I got more MA than I would have been entitled to SMP, as it's a flat rate, not based on your earnings, and as I'd had significant time off and not earned much my average wage was really low.

So what's you point in saying you returned to work a day after the birth? It's irrelevant if you are a man you don't even qualify for maternity leave oO

Some men don't even take a day off for the birth of their kids so it's not a biggie is it?


It's men like this, and opinions like his that make the workplace intimidating for pregnant women and those wishing to become pregnant. I imagien there was no paternity leave available to him at the time, as if there was, and he was my husband I'd have been awfully cross that he went straight back to work. Employers, and colleagues, are utterly entitled to their personal opinions, but if they were voiced to me like his previous comments, at work, I'd be complaining. I'm sure there are rules about discrimination and bullying in the workplace.

its a small company who own 4 residential homes. it doesnt bother me that i have to claim from the job centre its the point i only recieved a letter this morning from work telling me this when i was expecting my first months maternity pay on monday. so now i will be struggling for money till the claim gets sorted. as people have said above if my partner didnt take 2 weeks paternity i wouldnt be impressed, thats valuable time to bond with the child and let the mother have a rest, i could hardly move after having my daughter so i would of struggled at home on my own with a new born baby.

Tinkerbelle is 100% correct in everythign she has wrote, it does not matter you have only just come back to work after maternity leave....your still classed as working all the way through maternity leave so should make no difference at all if you have become pregnant again

i think your workplace are trying it on....

When broken employment can be taken as continuous

you have taken a period of statutory maternity leave, adoption leave, paternity leave or parental leave (in which case, that period counts towards your period of continuous employment)

print off this page from the DWP and take it into your boss, and use a highlighter to show the above

i had to do the same before and they were being complete tools about it after i threatened to get legal advice they couldnt do enough for me

It's just occurred to me that your employer has an obligation to respond to your maternity leave declaration within a reasonable time (this used to be 28 days from receipt of your letter, but I've been out of the game a while, and it may have changed = plus it depends when and how you notified them). If you're really peeved about the delay seek advice from the CAB and maybe file a grievance with your employer. Not much will come of it, but they might learn to treat pregnant people a bit better in future. It all depends on how good their HR people are, and how regularly they deal with it - where I last worked I was the only woman there, and the first - they had NEVER dealt with SMP, the right to paid leave for antenatals or anything. Good job I was their HR person!

When I dealt with it, the employer paid the SMP but could claim back up to 92% of it. So it does cost the employer albeit a teeny bit. I think the NI contributions are paid by the employer too... but I was HR not payroll. Just what I 'knew'.

I've just googled and small employers can actually claim back 100% PLUS a 4.5% compensation!! So they can BENEFIT from paying SMP!

thats what i thought, some companies pay the full wages as maternity pay, my friend got full pay whilst on maternity leave where as my company only pay smp which they claim back from the government i think. i just hope its not going to take long to sort out and i dont get past from place to place trying to sort out whos wrong and whos right, i will be on the phone on monday to see where i stand, when i first returned to work in april i asked several times if i was entitled to smp again and they never gave me an answer, i handed in my matb1 form they never said anything and then now i got a letter from them today. ive not been in work for nearly 6 weeks as i took 2weeks holiday before my leave so surely they could of told me then that i wasnt entitled to it. i handed in my matb1 form at the end of July and i had previously given them a letter stating when i wanted to go on maternity leave, i read somewhere that they are meant to get back to me writing stating when my return date to work is and they never did this last time or this time. to be honest i dont think they have a clue, when i returned last time they tried making me go back before i was due back. hopefully i will find a new job before my maternity leave runs out so i dont have to return there.
