McConnechy's MOT'd my car without me asking !!

Guys where do I stand here

I put my car in the garage today for them to check the breather pipe (as the smell of petrol as coming into the cabin while I was sitting idle) and also to check the back right tyre as I thought it needed balancing!

They called me up as they said they never had time to look at the tyre but they needed to order a part in as the smell was something to do with the oil (Fiat)

My lass went down to pick the car up and they have unbelievably went and MOT'd it for some strange reason!! When Lisa picked it up the guy said do you want to pay now or pay when you bring the car back...she obviously said when she comes back (she thought I had asked for it, why I didn't)

Now where do we stand? do they have a right to take back the certificate or don't they have a leg to stand on as they did a job I never asked for
The notes on the clip board will be proof that I only wanted the wheel and smell sorted out lol

The MOT is up at the end of this month altho I completely never asked for that work to be done

Well if you had it down written that you never asked for it to be mot'd then that is your proof, however I very much doubt they can take the certificate back now though, they must of assumed that the work you wanted was towards the mot, has it passed the mot now then? Can you just not tell them, and hopefully they may give a discount...? Its not like your car wouldn't need the mot soon anyway :)

I understand... I was just checking if it would have been illegal for the car to leave without the MOT Certificate.

I would speak to the service manager & ask him/her to clarify why they thought you had requested for this work.

It may have just been a simple mix-up with your & another customer's vehicle; so don't go in complaining if you don't need to. They may apologise & write-off the work.

However, as you need the certificate soon anyway, you could try & negotiate it at a lower than typical price because you didn't ask for it.

Either way, you need to speak to the garage otherwise they will be chasing you for the unpaid debt.

Not sure exactly where you stand but think the law was that they would make up the MOT to be valid from 12 months after expiry of old one. The way I think it applied/applies is that you can have an MOT certificate valid for up to 13 months. Someone will correct me if I am wrong.
This may make up for any expense providing that you havent had to pay for lots of extras to get it through.

PS. Whenever I leave one of my vehicles with a garage I hand them a piece of paper (typed, so I have a copy at a moment's notice) of all the work I am requesting (faults, warranty work, details of mileage, make/model, my contact details & so on) so that they are in no doubt what I have asked for.

It also offers a check-list to prompt me to ask when I get the bill what has & what has not been done.

It may be a suggestion to do the same next time; especially at the garage you took your vehicle to.

if it passed then I wouldnt moan about a refund otherwise they'll just cancel the mot I guess and then you have to return it in a month for another mot whcih might then fail lol

not at one point did I mention MOT....I know I didn't ask that because were short on money and was going to MOT at the end of the month (we would have more money if something was needing fixed)

Call the garage and tell them this exactly, they are the ones in the wrong, not you, besides you have proof of this.

as fanpages has said, speak to the garage owner, anything could have happened, if you go in and speak politely i am sure you will get to the bottom of this

You don't have to pay for it if you did not request this. Check the law relating to what their responsibilities are regarding MOT at the end of the month but when they raise an invoice make sure that they detail the works separate and then only pay for the authorised work.

When you do this you are putting the ball back in to their court. If they try and sue you for the remainder of the balance just defend it. They have to pay for it all and quite rightly. Hopefully they will write this off.

yes, they can cancel the mot certificate so you're back to one month left on your mot again so anothert garage visit, mot cost and possible failure repairs

Can you maybe explain your finances a bit to garage owner and ask to leave a post dated cheque for end of the month?

I'd be kind of happy if they'd MOT'd it and it had passed tbh - I know what Fiat's are like. =]

I'd be well happy too if MOT passed and it saved me having to take the car back again in a month. They should post-date the MOT cert so you still get 13 months mot cover

In a way yes. But I wouldn't be happy they decided to do so without clarifying with me, I'm not sure If I would use that garage again.

Bit cheeky tbh..but if its passed first time without them trying to charge you for any parts or rip you off,i wouldn't look a gift horse in the mouth...if they were true rip off merchants they would say its filed the mot and try and get you to fork out for unnecessary repairs.

If you are that short of cash then I suppose you could explain you never asked for it, ask them to keep the mot till the end of the month and you will come back and pay for it then - make sures its dated 12 months from the expiry of the old one though. If you do that, it will save you waiting an hour while it's done and the chance of it failing.

Well it was like talking to a brick wall, I specifically told the guy on the phone that there was no way I had said MOT, I suppose with all your comments I should just keep quite now :)

Think I might and just give it up, he wasn't going to budge on the issue

Just make them wait a month to pay & don't use them again.

(...and in future use the written instructions approach I mentioned above with any other service centre).
