GORDON Brown today promised that Michael Shields would learn whether he will be granted a royal pardon before the end of the month.

Responding to a question from Louise Ellman MP, who is supporting the campaign to free Michael, the prime minister said he is aware of the support for the Edge Hill student and his familys concerns.

But he said Justice Secretary Jack Straw, who has a team of lawyers examining the Merseyside Police inquiry into Michaels case, must have time to make a thorough decision.

I remember reading about this, I had a feeling he was innocent and they have evidence to show if I remember rightly.

Maria Shields, hasn't seen her 22-year-old son Michael since he was dragged from his hotel bed by Bulgarian police a few nights after seeing his team win the 2005 Champions League Final in Istanbul.


Michael's tragic story is not about one club or one city, it's about a young man being denied his freedom, despite legal experts, MPs, clergymen and ex-detectives saying the conviction is appallingly flawed.

Despite new witnesses coming forward to swear he was in bed at the time and authorities at home and abroad knowing his innocence is almost certainly beyond doubt.

And he remains behind bars for one reason. He was caught being an English football fan abroad. And when that happens you own no rights and earn no sympathy. That's why Michael's plight should concern you.

In May 2005 a waiter was attacked in a Black Sea resort and police went to a hotel to arrest the culprit. He wasn't there, so they tried the room next to his, where 18-year-old Shields was sleeping.

They made him put on a white T-shirt (the same colour as the attacker's) and drove him to the crime scene where he was put on show before witnesses.

At the police station he was cuffed to a radiator for 16 hours, while witnesses walked past to an ID parade made up of Shields and three Bulgarians. After shaving his head to make him look like a stereotypical hooligan, a judge gave him a 15-year jail sentence (reduced to 10 on appeal) despite there being no DNA or forensic proof, four witnesses swearing he was asleep, the hotel concierge saying he saw him go to his room, and another man, Graham Sankey, signing a confession admitting the crime.

A retired British detective re-examined the case for a TV special and said he was "appalled" at the conviction. Fair Trials Abroad called it a blatant miscarriage of justice.

When supporters raised £90,000 needed to pay his fine, Bulgaria repatriated Shields and told our government they could release him if they wanted. He took, and passed with flying colours, a Home Office lie detector test. Yet still he remains behind bars.

Justice Minister Jack Straw (despite telling the family there is powerful evidence to support Michael's innocence) says he doesn't want to set a precedent whereby anyone jailed abroad demands freeing on return to Britain.

Shields's legal team say this is an exceptional case, which is why they've been granted a Judicial Review to decide if Straw has the power to release him.

And I hope every football fan joins me in wishing his family all the best in this final throw of the legal dice. Remember this.

Had Shields been a public schoolboy on a gap year this government would have had him out in weeks. He's been denied his freedom simply because he's a working-class football fan.

And if you accept that, you accept that whenever you follow your team abroad it's OK for police to fit you up, courts to believe them, and our so-called 'football friendly' government to turn a blind eye to a human rights travesty.

The actual guy who did it admitted it but the Bulgarian police would not take any notice, he was on a doc about it with his face blanked out, im sure he was english? Just found this, article:

"Today Michael begged the British government to help free him and appealed to Graham Sankey, the man who admits carrying out the attack, to face justice.

Surrounded by his mother, father Michael, and sister Melissa, the 18-year-old said: "After I heard Sankey had signed the confession I thought he was going to come over here and face it.

"It got my hopes up and I began to think I'd be home in a few weeks but now I know that's not happening.

"It's got me down but the support from my family and everyone back home made me carry on.

"Before they put the lights out I read the papers and the letters I get sent to cheer me up."

my heart goes out to him and his family for what he has been through... have you seen tonights news about the pregnant girl away for drug smuggling. she got life! but might be getting an exchange to do her time over here either all her jail or part of. How quick was that sorted for her, she knew what she was getting into over there poor michael shields is innocent, was stuck in bulgaria for some time and is still doing his jail whats gone on there? pathetic you feel they do somthing when they can be bothered sorry rany over! lol

Poor bloke and i agree there is more than a little social politics going on. Fingers crossed
However the woman should rot in prison, couldn't care less is she was pregnant or not..

It's because he's Scouse, if he was a Cockney the Scum would of had a petition in full flight in no time to release the lad.

MICHAEL Shields will not be freed from jail early after he was refused a Royal Pardon today.

Justice Secretary Jack Straw announced the 22-year-old will not be pardoned after studying the results of a Merseyside police inquiry into his case.

But Mr Straw said he will review his decision if any further evidence surfaces which proves the Engineering student’s innocence.

Michael was understood to be devastated after he was informed of the news in his cell at Thorn cross prison in Warrington.

Unless there is a Government U-turn it means the Edge Hill Liverpool F.C. supporter will not be released until his sentence is completed in May 2010.

He was sentenced to 15 years for attempted murder following an attack in the Black Sea resort of Golden Sands, Bulgaria, in May 2005.

The justice minister insisted the evidence presented by campaigners and the Merseyside police inquiry he commissioned in February is not enough to prove Michael is “morally and technically innocent”, which, he adds, “is a very high test”.

City Labour leader Joe Anderson, who has led the campaign to free Michael, said: “This is outrageous. How Jack Straw can even use the word justice in his cabinet title is scandalous.

“He is not fit to be called the justice minister. The decision is an insult to everyone who believes in justice and the rights of the individual.

“The Government are officially keeping an innocent man in orison. It’s an absolute disgrace.”

The statement says: “Following a detailed and careful consideration of all the relevant evidence the Justice Secretary, Jack Straw, has made a provisional decision that the application for a free pardon from Mr Michael Shields should be refused. The Ministry of Justice has written to Mr Shields today to convey this decision.

“The letter to Mr Shields provides a full explanation of the reasons for the Justice Secretary’s provisional decision.

“Mr Straw has made his decision in accordance with the High Court judgement of 17 December 2008 which indicated that, in order to grant a free pardon, he would have to be satisfied that Mr Shields was morally and technically innocent. The judgement stated:

“In principle… the grant of a free pardon would appear to require a conclusion that, taking the Bulgarian courts’ judgement for what it is and without calling in question its correctness on the material which those courts considered, fresh evidence which the Bulgarian courts did not consider, taken with the material which they did consider and their judgement upon it justifies a conclusion that Michael Shields is morally and technically innocent.”

“This is a very high test and the Justice Secretary has provisionally concluded that on the evidence he currently has that test is not met.

“The Justice Secretary recognises, of course, that many will be disappointed by his decision. But in exercising this quasi-judicial function he has adopted the approach that the Court expected him to adopt.

“Mr Shields can now submit any further representations he may want to make, after which the Justice Secretary will make a final decision on the evidence before him.”
