Completely residential area, kids settled in bed and he comes driving up & down tooting his horn for business at 8pm - is he allowed to do that?

Does he need a permit or anything to trade here? Anyone know the regs?

I might be talking rubbish here but I thought with regarding to hooting ya horn, its suggested not to do it after either 10 or 11pm....like I say might be me just getting me wires crossed.

You MUST NOT use your horn while stationary on the road or when driving in a built up area between the hours of 11.30 pm and 7.00 am.

blimey though, didnt realise they still had moby chip shop vans, used to love them as a kid.

I know that's for a normal car horn, but not someone continuously tooting going up & down the road ... kids have now been wrestled back into bed anyway!

Now,admittedly,I dont drive but I always believed you couldnt toot the horn at ANY time unless its to warn other drivers of impending danger?

go and give him some advice...he is not allowed to toot his horn...so go and buy an ice cream van!

Just looking on google and lots of councils have codes of practise for use of horns/bells etc for vans that sell in streets. I would phone them up tomorrow and get their guidelines. They are quite strict for ice cream vans so cannot imagine why they would not be for this seller.

IT IS AN OFFENCE TO SOUND YOUR CHIMES TO
CAUSE ANNOYANCE
DO NOT SOUND CHIMES -
1. For longer than 4 SECONDS at a time - use an
automatic cut out device.
2. More often than ONCE every 3 MINUTES
3. When the vehicle is stationary
4. Except on approach to a selling point
5. When in sight of another ice-cream van which is
trading
6. When within 50m. of schools (during school hours),
hospitals, and places of worship (on Sundays and
any other recognised days of worship).
7. More often than ONCE every 2 HOURS in the
same street
8. Louder than 80 dB(A) at 7.5m
(Contact your L.A. for advice)
9. As loudly in quiet areas or narrow streets as
elsewhere

he went up & down the road tooting in short bursts (but it was pretty loud) - just really annoying at this time of night as kids bedtime!

Dunno, maybe a bit longer in bursts on & off... long enough to get the kids up is the problem ... if it had been at 5pm I wouldn't care ...

nope, it is a fixed penalty £30 fine for misuse of an audible warning instrument. Words of advice would probably be best, unless we got loads of complaints

i remember as a nipper the "pie&pea man"
he used to drive ringing a bell, we used to take out our own dish and he'd fill it up ;-)

Have a diplomatic word in his ear.

If it is 8pm as you say, residents will know when he is arriving so no need to alert them.

now THAT is awesome. I'm gutted we didn't have a pie and pea man when i was a kid. I don't even like peas but i somehow feel deprived.:thinking:
