HI can anyone give advice on this i got 2 mobile phones sent to me by mistake when i only ordered 1 can i keep the other one, some people say wait 3 months and if the company does not get in touch i keep it is this right

just use it but i doubt they will get back to you give it a week or 2. Then sell it.

A lot of it is dependant on the competancy of the phone company you're dealing with. If it's Orange, you're probably safe already.
What did they send you ?

make sure that you haven't been charged for 2, that would be my luck :roll:

if you haven opened it send it back in 7 days and they will be no postage charges or anything
if it is open call provider and cancel within 7 days then they will advise you on posting.
if you keep it you will be bill as a 12 month or 18 month contract as agreed no matter what you think.
you can only keep something if you can proove it is a pressent or to wait 5 years and 1 day legally.

I've had this happen to me. kept the phone , used it and heard nothing from vodafdone.
It was a Sony ericsson 900i- so must have been 3 or 4 phones ago. Also had a blackberry curve in Nov 2007 doubled up . lost that somewhere in cork so serves me right for keeping it I suppose.

Assuming they have only charged for one and they are the same phones then send one back as a return, not suitable - you'll get refunded on it. Then keep the other. If they charge you later it doesn't matter as you were gonna buy it anyway, if not then you've got a free phone!! Lucky you!! :thumbsup:

Ahah, like it - I (know people who:thumbsup:) have actually done that before but not with a phone, forgot all about it :-D

Got away with it, though!

Thanx for youre replies by the way it on O2 and its a sumsung F210 and pay as you go we got them both 19th december

Worst case scenario:
In 6 months they do an audit and find that they have sent you an extra phone. They contact you and say 'We sent you an extra phone and can prove it' and 'Why didn't you tell us like you should have by law?' and 'Can you send it back unused?' and 'You have used it so you need to pay us'.

Can you handle the slim chance of this happening? If it did could you cope with the consequences?
