someone owes me a refund for damaged goods, hong kong (tho on ebay their location was london PLUS they were advertising 4GB mp3 players, but there only 2GB) have a look, their feedback (ppl who realised it was 2gb...a lot of ppl) halimdehelen is the ID

This persons feedback is terrible, theyve really got on someones nerves, they keep registering accounts and bidding for 100+ with names slating the person.
The item location is LONDON, but if you look to the right where it says ask seller a question etc it says hong kong.
If you just hang on and wait paypal will refund you I THINK, as this person should have money going into there account all the time.
Have you raised a dispute? As this person also doesnt seem to contact buyers back when they complain.

i have done a paypal dispute. When i first complained they gave me an address to send the item back but all contact is very minimal pretty much saying send it back, send it back etc. so i sent it back as its no use at all. Now im waiting for my refund. i have a feeling there going to say they didnt get it. as when i posted it i sent it just air mail with proof of posting as i only had a 5a on me and it was gonna cost me about 5.80 or something...so i just sent it air mail.

i always read peoples feedback aswell and if a few say they dont contact when things go wrong, i dont use them. but they didnt have much bad when i bought it and most was for slow delivery, but i thought, some ppl dont send straight away, slow delivery to some people is like 5 days. so i dont know. a lot of people have complained and yeah it looks like someone is really upset lol i dont blame them i mean it tricks you. you put 4gb of music etc on the player, after 2gb it pretends to be uploading. then when you check the size thru the pc, it says 1788 or something like that. shocking really

Yeah ive been and read all the comments etc.
I dont really know what to say now as im not paypal expert.
At least you have proof of postage, but on the otherhand to that you could have sent anything (im not saying you have LOL! just saying that the seller could say)
Is it possible for you to give paypal a ring? I know if something like this happened to me i wouldnt be able to rest till it was settled so id ring them to find out.
When did you send it back? And what is the next paypal step showing as?

If i were you PERSONALLY id raise an ebay and paypal dispute, but i wouldnt have just sent the item back, id wait for paypal to intervene as by then i wouldnt trust the seller and my nose would be well and truly out of joint.

Ive never had someone raise a dispute on me (i dont really sell on ebay anymore since royal mails price increase and growing scammers) but ive a friend who did, paypal involved, she had to refund and the person kept the goods too! Cheeky sods lol

Let's go back to the beginning.

You filed a SNAD dispute through Paypal?
Did you contact the seller first?
Who gave you the address to send it to?
Please tell me you sent it back by ISF or Airsure?

I sent it back maybe last friday (not yesterday). aparently it can take 5-14 days to hong kong. I sent it well packed etc. it does say on paypal 'escelate the claim' (sp) my spelling is getting worse. so maybe if they dont recieve it by next week i should take it further. but surely selling it as 4GB and it only being 2GB is a trading standards thing right? they should be able to get done just for that. Paypal are not much help anyway id rather just hold on see if they refund me first, she hasnt completly ignored me so that is a good sign lol

Drop her a message through ebay, how long did it take for you to recieve it from her posting it?
Also did she send it the same way you posted it back to her?

I filed a item not described dispute through paypal. This was after a lot of table tennis emails with her. At first i did not realise it was only a 2GB as it wasnt working. I was emailing her to ask her to help me try fix it. all she said was format it and email me back. i formated it on my pc and realised it was only 2GB. I asked her why this was and that it was still not working (it powered on but nothing else happened). She totally ignored any of my questions and said for me to format it again using FAT not FAT32 which i had done anyway as it was stated in the manual (which was writting like a 5 yr old had done it)

The person i was in contact through email told me the address to send it back eventually after i said look im not happy etc and i was a full refund. she said she wont refund untill "the back item has hit my hand" which was fair enough, so i sent it but i didnt have enough cash on me to send it insured etc, so it was just sent airmail.

Steve i think its really up to people if they want to help mate, these are open forums anyone can give help or advice.
If i were you id advise you to give people your Yahoo email address or msn and you can help them through that as you did with me which was greatly appreciated.

No need to get heated up about people helping, remember its all good :thumbsup: :)

Oh by the way, ive got the balls rolling on my issue with my hong kong/australia seller.

I just opened it i havent took it further. If i get my refund i will close it. Just i was sick of them holding me off, i thought they were maybe doing it for the time to pass by and for it to be to late to do anything about

After the seller became unhelpful you should have escalated the dispute, then waited for Paypal to tell you what to do next.
They would have told you to get it independently checked OR to send it back to the seller using a trackable service. They would then have asked for the tracking number THEN refunded you in full.

As it is now you WILL lose the paypal dispute because you cannot prove it was sent, all you have is a CoP, that's not good enough for Paypal.

You cannot open a Ebay SNAD dispute because it will automatically go to Paypal because that is how you paid.

Once a Paypal dispute is closed by either Paypal or yourself it CANNOT be re-opened.

Let me check up on an idea I have and I'll be back. This may not be 'lost' yet.

Your eBay knowledge is good and you have helped a few people on here, so Thanks for that... But...

Please discuss with others all you want, please don't ask people to not help. Joshanna is right, the forum is open and all help is appreciated.

Quite often someone will know something another member doesn't. We can't all know everything about everything and this is how we learn.

The main thing is to get along with each other as much as possible and keep HotUKDeals a happy a place as it can be :)

ah, i see. well i never knew that. i guess ill just have to hope she honors her word and gives me a refund. i dont like buying electronics from abroad as the manuals are usually naff and it takes to long to sort stuff out. i should have noticed they were from hong kong

[SIZE=2]If your seller claims not to have received the item you have two options, claim from the Royal Mail using a P58 for a 'lost' item, but there is no guarantee that they will pay up, if they do they will call it a goodwill payment. [/SIZE]
[SIZE=2]The other option is to escalate the Paypal dispute, hope they tell you to send it to the seller and then tell you to add the tracking number to the dispute. To get 'the' tracking number send the seller a letter or something by ISF. I would also use AD (Advice of Delivery, your P/O chappie will do that). ISF is £3.50 and AD is 40p on top of the regular postage costs. I think £5.00 should cover this in total.[/SIZE]

[SIZE=2]AD is a postcard type thing that is put in a clear envelope on the back of the letter/package etc, the overseas postie gets the recipient to sign it as having received the item and he posts it back to you. That way the seller knows that you know that they have the item.[/SIZE]

Joshanna, Sorry if I was a bit blunt. I could see the problem from the OP's first post and I needed to get some info from him first before I could come up with an idea. I didn't want the OP closing the dispute or doing anything until I could give him the options. That was why I was a bit short. I'm sorry. :oops: :oops:

AD is worth an extra 40p for sellers that are posting overseas, because as I said above, the buyer will know that seller knows he has the item. ISF is trackable but is not trackable in every Contry. In my opinion this stops INR disputes. I use this at least once a week and I've had no problems.

Just seems a shame all this messing about for something misdescribed and crap TBH!

I've just remembered another 'help' option:-
Tell the seller that if they don't refund you straight away you will report every 'false location' listing they have and will have in the future:-

Don't have much confidence in Paypal when things get awkward: I got a faulty mouse from HK: seller delayed replying to e-mails until after the45 day period [I stupidly didn't take it up before then]. Seller offered refund and I sent it back, but he said he couldn't make a refund as there wa s a dispute unresolved, although Paypal had closed it. Fruitless e-mails to paypal. Even so, I can't see what there was to stop him refunding anyway, but it just led to stalemate. I eventually gave up and put the loss down to experience but just don't count on Paypal to help.

Your seller knew what they were doing, they delayed you long enough that Paypal could not help. It was not Paypals fault, it was your sellers.
Paypal is very safe on ebay as long as you have the £500 buyer protection and you follow Paypals U/A.

BTW, I think Paypal is a parasite and I would prefer NOT to use it.
