i got a charge back but my paypal went negative they have now threatened debt collectors????
any one got advice. how much do the debit collectors add on when they recieve it.

cos thinking is it worth paying the £100 notes rather than £200 if they get hold of it

my advice is pay it or you will get charged a lot more for the collectors fees and your credit rating will be mud

actually there emails don't state debt collectors, the website does!
i guess they have to email/post you warnings first

Thats not how it works. They sell the debt to an agency and its them that chase it for themselves. However, I trust that everyone that has received these letters have sent a reply to dispute the claim and also point out they have not persued this in another case that was highlighted on Watchdog.

Do not ignore the emails!

Send them back - in fact send them back by post telling them (by recorded delivery)! They are the ones who have suggested these people are trustworthy. They are the ones who who taken your money.

If they have applied a negaitive to YOUR account. Get in first. Take THEM to court. They wont turn up... you will win the case.

Dont let these bullies win. Dont let them be fooled. They will lose if you stand up to them.

I wrote an explanation to Paypal about the Chargeback process (from my bank to the Seller bank) not getting completed due to the transaction going back via Paypal and not directly with the seller's bank.

Then i emailed it to EVERY email address on the 2nd link from my previous post above. (Note: only 1 email per email address - as Paypal spam filter deletes multiple hits)

Here's what i sent to Paypal to get my balance returned to £0.00 :

To Whom It May concern,

I have been a loyal customer with PaypaI for a few years now but recently made purchases for £### with a Paypal Seller that turned out to be fraudulent ([url]www.musthave###.co.uk[/url]).

My Paypal account name : your email address here

( put details of your your initial Paypal transaction below )
#nd November #### - £### - Transaction ID Number #WP#####R########

I opened a dispute through Paypal for Non-Receipt of Goods who returned with a reply saying there were no funds in the Sellers Paypal account.

I payed by Direct Direct from my bank account so my bank (your bank name) raised a Chargeback (indenmnity claim) who authorised it due to Non-Receipt of Goods and returned the £### to my bank account.

Since doing this my Paypal account has now become Negative -£###.

I contacted my bank again and they said the problem is the Chargeback (indemnity claim) should have been directly with the Sellers Bank account to reclaim the funds.

But since the transaction was via Paypal the funds came directly from my Paypal account.

Effectively my Bank said Paypal need to complete the Chargeback (Indemnity Claim) process by taking the funds from the Sellers Bank account.

I have phoned Paypal Customer Services X times now to sort this problem out but they just don't want to know or provide me with any help whatsoever.

I also recently watched BBC Watchdog regarding a case about Non-receipt of a Nintendo Wii with a company called Ozone Electronics where customers had the exact same problem as i'm having with Paypal stopping the Chargeback process from their banks.

BBC Watchdog then said that Paypal had refunded the money and completed the Chargeback !!!

Do these Ozone Customers get preferential treatment from Paypal ????

Please can you help me sort this problem out ??

Tell the debt collection agency that this is in despute and that you will be contesting this in a court if it needs to be. Tell them that if the debt collecting agency supply the goods, you will be happy to pay them, but you are not paying because Paypal are too lazy to do the decent and honest thing.

Explain that Paypal have agreed with your points of view to several others and this evidence will be presented to a court to let a judge decide.

It is Paypals responsibilty to get the money back. This should be done via the sellers verified BANK ACCOUNT. Just because this guy has done a runner and emptied his Paypal account, doesnt mean it gives the right to ignore this and go after the easy option.

i don't have a leg to stand on according to them. they say they provide a service and paid the e-cheque on my behalf.
the financial ombudsman service say they'll take the case on but at the mo paypal don't owe me anything? think maybe i should pay then take action against them

Agreed. They are relying on the fear factor - and to be honest, talking out of their backside. They are just as comperable in this as a credit card company. ie you have paid the money to them on their secure service and have not received the goods. I doubt very much a court would back them up - which is why they would never use a court.

A recorded delivery letter should be posted to them instructing them that you have used their services to purchase goods that have not arrived. If they are trying to say they need to reclaim the money from the chargeback, inform them to write directly to the bank that was used by musthave100 and get the money from them. If this companies bank and Paypal do not checkout its customers properly, then suggest they do so next time and stop pestering you! You need to spell out that this debt they are trying to pass to you is desputed and that you will take it to court if they insist. DONT do this on the phone - youve already seen thats pointless. Make sure you show that you are cc it to the Financial Ombudsmen services and to Watchdog. Spell out also that you are aware that other people have already been refunded in exactly the same situation as this and that these people would be prepared to appear in court to demonstarte that fact. I'm fairly sure that someone on this forum would be prepared to do so if the need arrised. But even so, they wont like seeing this and will back down. But they will carry on until you PUT IT IN WRITING. (And make sure you send it recorded delivery.) No one can do this but you!

Thats because you are not taking the advise being given. Dont ring them - write to them.

Depends if you are deputing it or not! If you are, then dont pay it.

Who are you referring to as paying to? The agency or Paypal? If its the agency - tell them you are in dispute if they call. If its Paypal, just refer them to the letter you have sent and awaiting a reply.

To be honest, since Paypal are not answerable to FOS, they will probably throw that in the bin.

Just received email notifying me that my paypal account is now back to zero. Thanks to mecoconuts, i sent a similar email to paypal complaints AND IT WORKS !!

Im thrilled, load off my shoulders. I have learnt a very big lesson with this experience, especially with paypal.

Hope the same happens for everyone else who were sh*t on by these *******************:whistling:

When i checked my paypal account, as i said above the negative amount had gone and the balance is now zero.
When i arrived home today, a message had been left on my phone for me to contact Intrum Justicia before 9pm. I am worried sick, i will stumble my words, getting all tongue tied. What shall i do? I thought it was all over AGAIN.

So stressed, any advise appreciated

Dont panic!!!

Definately give her a phone call to hear what she has to say.

Hopefully its just to tell you that your "debt" is no more.

If it isn't and she is saying you still have a debt, read the email you have received telling you it is now a zero balance. Inform her that your health has suffered through this and that if they continue to bother you, you will contact the police for harrasment. They have already conceeded to you and several others and that it is unacceptable to keep this going.

Advise her to speak to her bank to find out about how chargeback works - and it is for Paypal to contact the bank for "musthave100" to pass back the charge that this money has been laundered through.

Its a shame I cant ring for you! I would love to get my rottweiler teeth into them!

I would also advise if you can, to record the call - but make sure you tell her that you are doing so. (Spell out its because this will be used in evidence against Paypal in a court, should the need arise.)

And.... good luck.... deep breaths, stay calm. Have the facts to hand..... and make them stumble instead!

Thanks so much for your support, and making me laugh.
I just rang paypal and asked them why i have been contacted by debt collectors and they said it sometimes takes a while for them to receive the details.
I then rang Intrum Justicia and told them.
With a snotty tone they told me i would have to send proof if they hadn't heard from paypal in a weeks time.

Not doing me any good keep getting these palpitations. I definatly DO need to learn not to panick.

I didnt realise this call was debt collectors.
If they had said that to me, I would have told them I would be happy to inform the court that you have ignored what has been said and that they are too damn lazy to contact Paypal to verify themselves! Perhaps they realise how difficult it is to deal with them! Anyway - its not your problem. If they ring again, tell them to take a hike - and should they be foolish enough to ignore you, you will meet them head on in a court with a counter claim. Did they tell you the name of their company? Please reveal!!

Relax though. You are in the clear.

It might be an idea if you call them and instruct them to inform you when they have heard from Paypal, seeing as they have issued you with a threatening letter. Since they have put that in writing, its not unreasonable to expect an undo letter!!

Still think you should be sending a letter by recorded delivery - and include "cc Watchdog and FOS". I know a few people have been successful with email - but a recorded delivery letter spells out intent and cant be ignored (unless of course they want that further fact to fuel your case!)

I would also ring back the DCA and inform them that you will be letting Paypal know about their obnoxious and unnaceptable behaviour and instruct them not to bother you again! Always ask the persons name you are speaking to before proceeding - and ask them what they hoped to acheive by slamming the phone down! Must admit, DCA really are obnoxious. They really dont care one jot apart from getting money and will use whatever tactic they think they can get away with. Make sure you let them know you have involved FOS and Watchdog.... they wont like that one bit!
