my manager don't want to give me my holidays

I work in KFC. I still have 12.5 days of holidays. I found new job, much better. I told him that I stay my last week as full time worker and from next week I will be part time worker. I don't want to quit from KFC. I even don't want to go for this holiday. what I want is money for this holiday. he don't want to send the form. KFC take the average from last 8 weeks to pay holiday, so I want this holiday now when my average is really good. he afraid that I quit soon after my holiday payment. when I take this holiday later, that will be like half of the money.
what I can do in this case?

PS. sorry for my English. this is not my first language.

How much annal leave are you entitled to and when is you leave calculated from. ie. 20 days to book between January to December inclusive.

annual 24 days holidays
we don't have any restriction when we can take holiday

if your asking for money instead of taking the holiday he cant do that, comes under health and safety, you have to have the holidays

however if you want to take the holidays after you change to part time working that depends on how many you have taken this year already, remember holidays are spread out over a 1 year period, if you dont work the full year you dont get the full years holidays, it depends on how many you have taken, and how many you have left

part time workers have 24 days too.
at the end of year my previous manager always send holidays forms for everyone when they still had some days left. we was working as usual and on payslip came money for job and holidays. if you don't use your holiday in full they don't give you money back for that.

lol, sorry about my spelling...... Annal leave, what an idiot!

Anyway. Your leave must be bookable within a 12 month period. If you had 24 days starting from January for example you will only have earned 16 days for the months January to August inclusive. Any leave already taken is obviously deducted from this. Which is what I was getting at!

in other way: when I take it now, they will pay me about 500 pounds
when I take it few weeks later they will pay me about 250 pounds.

for me is a big different

if you really do start having problems, go to citizens advice.

they may advise you to go to small claims court. in my experince, and from and listening to others who have had a genuine claim, you will win hands down.

i know where you are coming from. Having worked for Rileys our holidays were based on my previous 8 weeks of work (irrc). Now, normally my avg week was 15hrs, but for the 8 weeks before my hols, I had worked 2x 15 + 6x 30 plus, giving me a canny avg workin week of about 26hrs per week. I took my holiday (from work), and stopped at home for a week, claiming a 26 hr working week. My hours dropped after that so i was best taking them when i did.

I think you will find most english people who move to other countries are not fluent in either english or the language of the county they are going to live in. This guys english is pretty good compared to my french when i went over there :thumbsup:


Agreed this person is making an effort and speaks better English than most of our home grown chavs, and they actually work. Trying to learn another language and in full time work, I'd rather have this person than the scum this country is filled with at the moment.

I ask for help and now we are talking about some bullcrap. it doesn't matter do I know english good or not (i 'm not stupid and i know that my english is fare from perfect), it doesn't matter do I take some benefits or not (btw I don't)

1st I want some advise ( and I have it: citizen advise)

3th I am simple but ambitious guy, well educated (not in english like other people realize)

maybe I am from "these people" for someone, but I try to improve (and believe me its challenge for someone outside UK). Finally someone appreciated that. we are on hotUKdeals (I wish to find this website much early). For me is a big deal to don't loose this money. I have to work over 50 hours to earn enough for bills etc...

Sounds like your finance is really tight. From what I can tell, I believe you want money instead of the holiday? Or is it paid holidays you want? (a bit like sickness pay, where you still get paid if you are sick)
Anyhoo, my advice is to try to talk to the manager again. I don't understand the system btw, so I can't help you with law threats or stuff like that.

If you're struggling to pay the bills you're probably entitled to some benefits, free prescriptions etc you should go read up on it though.

unfortunately not. we earn (me and my wife) to much.
but even without benefits I have better life in UK than in my country

oh well then, as said above go talk to your nearest citizens advice they are free and really helpful. If it doesn't seem like you're going to get the money just quit and claim the £500. Plenty of fast food jobs around.

I used to work for Tesco and they paid my holidays, but my current employer refuses to pay my holidays, I HAVE to take them or they get carried over to next year maximum 10 days.

Not really since when I was working minimum wage 20 hours a week I was entitled to £4 a week housing benefit(which since wages went up im no longer entitled to) and had to pay for prescriptions and ended up being lucky to have £5 left for food and luxuries at end of week and no one cared.

if over 25 though then you get working tax credits which means you get about an extra £50 a week if on minimum wage working like 30 hours a week

I never said they speak bad English, I said this person does, and funnily enough I don't have a map of where every single HUKD member is from, so stop making things up and get a grip.

How do they work out your holiday?

It's only because every job i've done you get your holiday allowance (say 30 days per year for a full time 40 hours per week position) you get that at the beginning of April to last 1 year, you can take it when you like.

If your only part time you get your holiday allowance on a pro rata basis so if you only work 20 hours per week you get half of that allowance so 15 days. If you work only 10 hours per week you get a quarter of the full time allowance.

So surely if you have done about half of year on full time you will only be entitled to half the holiday allowance an then you will get a pro rata allowance for any time you do in a part time position.

So basically I think the reason he doesn't want to pay you for it is because you want to get the money for a full time holiday allowance but wont be working the whole year full time.

holiday entitlement on average is 24 days full time that is if say you work an average of 5 days a week (companies vary)
basically its somethnig like a week every 3 months
how our company works it out is the average of the last 3 months
say for example i work 3 days a week one month 5 days a week the other and 4 the last month
my holiday entitelment wil be 4 days (1 week)

and of course if i wish to take a holiday it has to be approved
