Today, I had a phone call from a debt company. (I forget the name) Phoning on behalf of Tiscali.
They said that i owe Tiscali money, because Tiscali took my details down wrong the direct debit hasn't been coming out of my account. Now I've been with Tiscali for 2 1/2 Years and i owe them £580!!
Needless to say i was very angry with the guy that phoned, even though im just a name on his screen.
So, as of now I haven't phoned Tiscali yet, i wanted so advice/help on what to do or say.

A few things have bothered me about this:
1. Why didnt they get in touch after the first/second month to ask fot the money?
2. I moved home 18 months ago and they chnaged my broadband to my new home, nothing was said about owing any money.
3. I upgraded 12 months ago and nothing was said.
4. I phoned them a month ago to asked for a free wireless router (they said no) and nothing was said about money.

It all could be my fault as i didn't notice that money wasn't coming out for tiscali, but i have alot of direct debits like everyone else, and I really think that I should have notified me after the first payment was missed.

So, if I have to pay back the money, which I'm sure i wil have to the debt company asked to to arrange a payment i can handle, so £20 a month sounds about right.

So, If anyone has any advice about my opions or anything else then lease post.

Thanks in advance.

Oh, and the guy from the Debt company also said that this had happend to many others.

Have you checked that the direct debites haven't been paid? They might be able to arrange a payment plan fingers crossed.

just ring tiscali and work out a repayment plan.

You really need to get some professional help on this rather than a lot of different points of view on a forum. No disrespect to anyone trying to help.

There are all sorts of unanswered questions.

I suggest you make an appointment with your local C.A.B. and make sure you see them armed with the FULL facts.

And if you're admitting non payment then csiman has the best idea although apparently it is now in the hands of a Debt Collection Agency ??

Haha, that's kind of a weird thing to say.
Tiscali should have realised they hadn't received payment!
and then re-sent an invoice within an acceptable time period!

I recently had this problem, my direct debit couldn't get set up by orange so within 2 weeks they phoned me to which i paid my bill (I paid an extre £3 on top of what i should have, but it beats a £10 missed payment fine!)

I personally believe that Tiscali are in the wrong and shouldn't expect customers to pay the full amount back, if any!

I could understand if it had been 2 weeks up to 8 weeks but no more than that!!

Ask them all those questions you said were bothering you! Something doesn't add up as normally they would or SHOULD have contacted you regarding the first couple of "missed" payments! Plus if it was a direct debit it should have occured to them that the details need checking therefore contacted you!!

2 and a half years is a long time to not have contacted you and to pass it on to a debt collection agency straight away without contacting you themselves - thats a bit strange!
They should have sent numerous letters to you first trying to collect the money!

>but i have alot of direct debits like everyone else

This is why it is VERY important for everyone to check what is coming IN and going OUT of your bank account (and credit card) every month.

Suppose, for example, Tiscali had written someone else's account down wrong and had started taking money out of YOUR account by mistake.

You could have been paying for someone else's Broadband for the last 2 years and be totally unaware of it.

In these days of identity theft it is more important than ever to check what is going out of a bank account or credit card.

Couldn't agree more it doesn't take long when your statment comes in to check all payments have been made that month anf that there aren't any you don't know about.

Both sides are equally at fault here IMHO.

That is why I se MS Money software. You know exactly where you stand from day to day and even 6-12 months in the future on current spend levels etc. Its so easy to setup and five times now I have noticed erroneous debit / credit card amounts / transactions.

I even noticed that a cashpoint I visited (Halifax) was not registering all of my withdrawals. I use that one all the time now ;)

About £200 up - lol

It's stupid they not notice, don't know what to suggest apart from going to the cab.

We had the same problem with tiscali although we kept calling them telling them they wasnt taking the money, then after about six months the debt collection company wrote to us, so I called Tiscali about this and to their credit they cancelled the debt but told us in a round about way we was leaving their services!

I think you should definately check your bank statements. Do you know the guy from the debt company was actually legit? You're better off speaking to Tiscali firsh hand rather than through an intermediatery.

Good luck!

iF TISCALI HAVE NOT OFFERED YOU A SERVICE, IE. YOU HAVE OBTAINED THE SAME SERVICE ELSEWHERE, THEN YOU SHOULD NOT BE LIABLE AS IT HAS COST THEM NO MONEY. COMMUNICATION WITH THEM IS THE KEY
