Need some advice- nvr got paid

I was supposed to get paid on thur, but the put a money in my bank then recalled it as it was an overpayment, but theres no sign of them payin me the correct amount, i didnt even get a payslip,

i did get overpaid but have agreed to pay that bck on monthly installments,

and i have constantly been asking HR when i am gettin paid they say there waitin to hear from payroll and payroll say i have to speak to HR

i am leaving the company, last days wed, but surely they cant just nt pay me :(

any advice in wot a should do???

they have to pay you - how much do you owe them - due to their error??

they might be holding out so they get what is owed to them -

so you can shout for your wages that were due on thursday , your contract states that

did you agree to pay back the overpayment - if so what was the agreement - so much a week??...

:|well the overpayment i dont have any formal agreement as of yet all they keep sayin is you need to wait till payrole to get in touch but i have said i can pay around about £50 a mnth till a get a better job, that was all verbal nothing in writing as of yet

i have been shouting for them i actually have no money to do anything

So you spent the £4000 and are paying it back at £50 a month, thats 80 months nearly 7 years? Im not surprised they are stalling with your wages if you are leaving next week. Im sure they want to make sure how they are going to get the £4k back first.

they overpaid me i didnt ask for the overpayment and i said £50 for the time been until i get a btr job that pays me more, and at them moment a cannot afford to pay them a £1 nvr mind £50

Well why did you spend the money? You must have known the would notice and want it back! You should have just sat on it and made a bit of interest. Id like to feel sorry for you but I feel its also your fault that your in this mess.

You can't seriously expect them to pay you after they over paid you £4k and you steal it

i think you will find that due to the large amount they are quite legally in their right to hold on to your final pay cheque - and then arrange a repayment amount going forward - they do not have to accept the amount you state and can if they want take you to court - if the judge finds in their favour - which to be truthful due to the amount he will - he can say you have to pay it back all in one go and also give costs againsts you - this will mean the debt will go up and up and up if you dont pay up - if i was you id negotiate quickly and hope they accept your proposal

So what did the CAB say when you went to see them?

Did you take any advice offered on your last thread or did you just ignore it all?

i don't see why they'd part with even a penny if they're owed 4k. wouldn't they see it as paying themselves? it's only going to go back to them anyway.

if they owe you, for example £500 and you're willing to pay £50 a month it'd take 80 months but 70 months if they don't pay you the final wage. the Citizens Advice Bureau could help perhaps. it'd be interesting to see how you stand on this, keep us informed please.

@ gavinlewishukd, i didn't nick your avatar in case your wondering. i got mine about 2 weeks ago by typing 'cookie monster' in google and picking the first small picture that came up (inspired by the colbert report which featured him). when did you get yours?

i took all the advice that was given in my last thread and went to speak to CAB, but that was abt the overpayment, not abt nt gettin paid

Did they say you could end up without any wages this month? Try ringing the person you spoke to and telling them, they will already be familiar with the case so might have some advice

So you got overpaid £4000 and expected to get away with it. You deserve everything you get (i.e no final salary - it is theft after all!).
