New handset query - Three

I wonder could anyone help me. I currently with three and have about 8 months remaining on an 18 month contract. my phone at the moment (nokia e61) is playing up something awful, keeps switching itself off. ive tried everything from a soft reset to updating the firmware and nothing has improved. If i committed to another 18 months from this point, would they allow me to get a new handset and pay the monthly cost on top of my bill? (e.g. Nokia n95 is an extra £15 a month)

15 pounds extra??? for 18 months is £270 surely the n95 can be had for less than that
Unless I'm very much mistaken, Nokia handsets have a 2-year warranty...try taking it to your nearest Nokia service centre (or call Three and say your handset is faulty) and see if there's anything either can do with it, before recommitting yourself!
Under Sales of Goods Act 1979 Three are oblidged, unless specified differently upon sale, to give you 12months Warranty on that phone.

With three you have multiple options:

1) Call them, listen to them go through all sorts of **** to try and discover the problem and get nowhere fast wasting alot of time

2) Email them via with specific details saying you have tried everything quoting SoG Act and they are oblidged to repair it within 28days of complaint, again this will take time

3) Visit a Three store, this should be alot faster there're arn;t many of them but if you can find one they should be able to sort you out but will probably take the phone away
Three will always collect and repair your phone if you ask
All they have offered me is a refurbished handset. i have emailed them asking about this and am waiting on a reply back
