O2 and Buymobilephones.net

Hi,

Got a dilemma, ordered an upgrade through buymobilephones.net about 2 weeks ago, this went through, everything was alright and phone was working, now o2 have disconnected the contract stating they never recieved an order to upgrade the contract, o2 are refusing to do the upgrade now they have downgraded the number to pay as you go stating im no longer legally obligated to pay them anything other than the final bill.

So i rang buymobilephones.net, they are stating that the upgrade order has been put through successfully and as far as there concerned if the phone doesnt function on the network i should contact o2 to discuss this.

So to solve my problem I went to the o2 store and got a new contract again, now I have 2 mobiles and 1 contract, where do i stand in all this, because o2 are refusing to help because i no longer have a contract with them, buymobiles are saying its nothing to do with them now because there not the network provider.

Any help is appreciated

    Oh and I have all this in writing from o2 as they sent me a transcript of both the call and live chat discussion, and the call to buymobiles was recorded

    So you got a phone for nothing? That's just as guess as your question makes very little sense (no offence).

    Yeah sorry, im trying to kinda make sense of it all myself

    Basically

    17th June - Upgraded through buymobilephones.net, received phone a couple of days afterwards, was working fine until today,rang o2 and they terminated my contract today stating i never upgraded and im now a pay as you go customer and today was the last day of my contract.

    on buymobilephones.net t&c's it states thay can charge me £240 for a termination of my contract, but i didn't terminate it, o2 did because they apparently never was told to upgrade it.

    So dunno where i stand now really.

    How do the website know if my contracts been terminated or whatever, surely they aren't allowed access to my account with o2?

    O2 send a monthly report to their dealers/stockists/retailers advising them of new connections/upgrades and any connection that has been terminated. This is so that the retailer can claim their commission and also so they are advised which contracts they cannot claim commission on because of early termination.

    RIght ok, but ive contacted buymobilephones.net and advised them of the problem but they didnt want anything to do with it, also if o2 have never recieved an upgrade order, are they likely to send them a report on my contract?

    Now im confused, o2 have told me they are not allowed to supply personal contract based information to any third party retailer, so according to them they are not allowed to tell buymobilephones.net whether my bills are late, or if my contract is terminated, its down to me to inform them of that

    They will not provide your personal information. They will give a statement to the retailer to the effect of: 'O2 Number 07999 333111 - Early Termination - No commission Due'.

    Your retailer then will use 07999 333111 to trace in their records who the customer is and will then take appropriate action. At no point will O2 say 'Mr. A N Other of 3 Some Place with phone number hasn't paid his bills'. So no personal details are disclosed.

    Please be aware I am simplifying the process so you can get a gist of the process.

    Your upgrade issue seems to be slightly odd. Normally if you don't upgrade, you continue in your prevailing contract. The fact that O2 has 'downgraded' or migrated you to PAYG seems very strange.

    In the case of the phone that you purchased; it is a subsidised handset. In order for buymobilesphones to recoup their money, they will seek commission from O2 for the upgrade. When O2 receive their claim, they will check a valid upgrade has taken place. If it hasn't or early terminated has occurred (as it seems in your case and I still don't know how) then O2 will advise buymobilephones that No Commission is Due and they will give them the reason for the rejection of their commission claim. At this point buymobilephones will decide what action to take, including asking you for the £242 they have stated.

    If O2 has not upgraded through no fault of your own, you should not be liable for the £242, although you would be required to return the handset to buymobilephones. You may be lucky and all this slips through the net, but if buymobilephones do chase you, be prepared for a fight. Make sure you keep all correspondence, including e-mails.

    Yeah cheers, ive got all the emails saved in a special inbox now, so i can show both parties Ive attempted to rectify the issue at both ends, i dont have a problem with returning the handset if they do, all i realistically want is a working mobile phone, lol

    Tell buymonilephones.net that your contract is with them and not O2. It is for them to sort out, not for O2.
