O2 contract problem - friends contract - sisters name - update

My sister's mate decided to take out a contract at car phone wear house (CPW) with o2. O2 directly send bill ect

Friend was declined contract with o2
Sister at the time took the contract out in her own name with condition that it went in to her friends bank account and her friends address. So her friend had to pay a £150 deposit not sure if it was for the phone she wanted or to get the contract.

So anyways after a few weeks to a month the account address was originally address to my parents house where my sister stayed at - at the time, so anyways the address on the account got moved to her friends address and was taken out her friends bank account for from day one.

So the first few months the bills where fine as she was in credit with that £150 they took but a few months went on and she couldn't pay a month and went in to arrears

My sister got a letter saying that she would be disconnected or have incoming calls only on this o2 number which her friend has if she didn't pay the areas balance - she contract her friends to pay this amount and the line was re enabled.

Anyways the bills paper / paper less went to her friends own address came out her own bank but was in my sisters name and the online account details where sent to her email account as well so she had full access to everything.

So sister decided to check her credit rating and she discovered that her rating went down and noticed that the o2 payments had been defaulted and its affected her credit rating and now after contacting o2 they apparently have

Disconnected the number in November 2009
Received some sort of payment in December for an amount not sure how much
Have not received any payment from December onwards and forwarded it on to debt collectors.

The problem is now this

My friend has

No job since November
moved address and not updated the records everything goes to her old address
not told my sister where she lives
changed her mobile number so many times in last few months - nothing is active - ie dead line/number no longer available or the phone is switched off and goes on to the answering machine.

What can my sister do.
She has not heard from this girl for ages and has no method of contract with her with her as shes moved. face book no reply. mobiles off or dead, emails ignored or spammed back,

o2 apparently say my sister cannot pay it in full and o2 will name take any payment from my sister at all they say the debt collectors are dealing with it but if any letters that have been sent have been going to her friends old house address!

Can any one give any advice

? Have told her to contact the citizen advice bureau and see what they can suggest

sister paid it on cc and asked for receipt from dbt collectors, can she take her mate tos small claims to get the money back

Sounds like a bad and stressful situation, but if the contract is in your sisters name then I would have thought she would have to pay it.
The friend was declined on the credit check, which indicated financial issues, why she didn't go for payg and why your sister offered to take on her contract (and therefore any debts incurred by that contract) is something I will never understand!!
Try and get the details of this friend's family, maybe her parents, and explain the situation to them - that would be what I would do as they should give you her details and maybe they will try and knock some sense into her.

After something similar happening to me, I now refuse to take out ANYTHING in ANYONE elses name other than my own... Friend, family, doesn't matter. Best to be safe than sorry as its too easy for them to walk away leaving you to foot the bill leaving you to pay the price.

To be honest, I don't think she has a leg to stand on legally as it's in her name, therefore she is responsible regardless of the bank account details being her friends.

Does she not have ANY contact details for family members of the friend?

she may have her boyfriends work email but not sure if he would reply - shes tried contracting the bf of the girl and his phone is off, this girl is expecting hence the reason she has no job. And doesnt have her fathers contract details no more either as he may have moved on also

they want a sum of about £300 or less at the moment, but my sister can pay it in installments or in full but would leave her skint for next few months, her other credit items my sister has are fine no problems all up to date and on time,

she can pay it installments but o2 said its in debt collectors hands but has no idea who they are ect - will be in touch with my sister tomorrow to tell her to deal with any one not in paper. she has links to o2 threw her work as well which might affect her would it ?

Just use any methods available to you to contact this girl or anyone close to her who can give her details, it's the only way your sister is going to get this sorted without being out of pocket.
I guess she's learnt the hard way - NEVER sign and take on a contract on behalf of anyone else (friends or family) and always read the small print.

I would have thought the £300 charges would not stop there? How long was the contract for? She would have to pay the balance plus the amount of line rental to the end of the contract!

I think she needs to become 'Inspector Morse' and do some serious investigation to obtain details. Even if she gets details, if the friend refuses to pay there's not much she can do other than pay the amount herself, no other choice really - it's in HER name:oops:!

I don't think theres anything she can do about it...Has she tried writing and explaining (i.e. Begging) to CPW??? Whats more even if she does pay them off, your sisters credit rating will be shot...

This is possibly the most ridiculous post I have ever read.

No offence to OP - youre not the stupid one, but your sister clearly is. What on earth was she thinking?!

I very much doubt there is a lot you can do - but seriously someone needs to educate your sister and fast.
