Old EmpireDirect 3 year warranty

Bought a washing machine in Dec 07 and had a 3 year warranty on it.

Now I need to claim on it but they've since gone belly-up (or trading under the Richersounds banner), I understand that contacting RS they will tell me to see my credit card company.

What's the chances of getting any joy from the CC company? Will they uphold the repair? What's the norm for this situation?

Anybody been in this situation?

Yep - on a purchase about a month before.

They don't honour the warranty as it was supplied by themselves and since they've gone bellyup...

Found something on MSE about it...will read further...

OP I bought a double oven from them in January 08 with a three year warranty and it stopped working couple of months back - I called up Electrolux and explained situation and they sent out an engineer no problem at all. They told me to show engineer paperwork ie. delivery note and proof of purchase.

Have u called the manufacturer as if you havent its def worth giving it a go

EmpireDirect (Richersounds or whatever) say that they bought the web name but not the debt (how this is allowed is beyond me), and are not liable...but they will give me the amount remaining of my warranty as a discount towards a purchase on their site(!) woohoo...:x

When we bought the washer, it has a 5 year Hotpoint warranty too - but the fine print stated labour only or parts only...basically one and not the other.

I think my best bet is the CC company as I bought the warranty using that, but will look to Hotpoint if that fails.

I thought there must be loads of people in this position (faulty merchandise from ED) and wanted to hear where they stood.

no hope from the CC tbh - the claim will be too old, therefore invalid. The person who owned Empire is trading again under a different trading name

Whilst this might seem not particularly fair, this is the norm. If the firm had to take on board the liabilities, the liquidators wouldn't be able to sell off the assets (and seek the best possible price). So the creditors of the failed firm would be worse off, and the customers of the firm would be no better off.

What's not right is the fact that they can cherry pick the best bit - the name. At a first glance ED are a reliable company that's been trading for years without a hiccup...

A 3 year warranty bought on a credit card, and flagged after 2 is my best course of action.

Was reading that the manufacturer (Hotpoint) are no use in these situations after reading feedback (and reviews on our model). I remember buying it and thinking 'Well if we get 3 years out of the ED warranty, then we are partly covered by Hotpoint's parts-only for a further 2'. But 2 years down the line we are looking at a new model, as the machine itself seems a very poor model we could be throwing good money after bad should it develop another fault after this one.

Does anyone have details of the terms of the old warranty? I lost most of my online purchase documents in a hard disk failure (everything backed-up except Outlook e-mails!) & before going to the Credit Card Company about the problem I'd like to be sure what the warranty actually covered - i.e. accidental damage in particular.
